If Chris Christie is truly knocked out of the running for the GOP nomination in 2016, then who will take his place?

No, that’s not a setup for a list. I was wondering whether y’all had anybody in mind. I can think of only two categories:

  1. Unbending ideological extremists.
  2. People most of us, possibly including me, have never heard of.

Regarding that second category: You may say that there’s somebody great out there that I’m not thinking of. But in my book, someone I haven’t heard of has next to no chance to gain my confidence between now and 2016. When it comes to doling out (more or less) extreme executive power, trust is a cumulative process with me. It takes time for me to be able to see someone as president.

I was feeling pretty good there looking at a Clinton-Christie matchup, as it meant the choice would be two people I felt moderately good about. That is to say, I wouldn’t have seen the election of either as a disaster, which gave me a small measure confidence about the nation’s future. After her four years as SecState, I felt better about Hillary than I did in 2008. And after watching Chris the last couple of years, I thought I saw the kind of pragmatic governor that I like.

In any case, he was the only Republican I could think of that I felt kinda OK about (while Hillary is kinda the only Democrat I can think of, good or bad).

So… if he’s knocked out… what happens?

Did you shake your head when you read this, which appeared under the Bizarro-World headline, “Clyburn too conservative?

WASHINGTON — U.S. Rep. Jim Clyburn is used to political foes calling him liberal. They’ve been doing it for years. Now, though, prominent liberals are coming after him for being too conservative.

Several left-wing groups are criticizing South Carolina’s Clyburn, the No. 3 Democratic leader in the House of Representatives, for his relationship with one of the party’s influential centrist policy organizations.

The founders of that think tank, Third Way, attacked U.S. Sen. Elizabeth Warren, D-Mass., last week for pushing tax hikes for the rich and increases in Social Security benefits, and for taking other stances that they said represented risky fiscal approaches and bad political strategies.

Allies of Warren, a freshman lawmaker who is a rising star in Washington, struck back quickly.

Four liberal groups asked Clyburn of Columbia and 11 other Democratic members of Congress who are “honorary co-chairs” of Third Way to repudiate the condemnation of Warren and sever their ties with the organization…

Do you recall, back during the Democratic Convention last year, when I highly praised a speech by Bill “Third Way” Clinton? Aside from the fact that it may have been, as I said, the most skilled and powerful political speech yet in this century (and as I noted at the time, that was coming from “the editor who presided over an editorial board that was tied as first in the country to call on him to resign after he admitted lying to us”) — certainly the best I ever heard from Clinton — my positive impression of it was heightened by the fact that it followed an atrocious rant from Elizabeth Warren, which I characterized as follows: “She gave one of those speeches full of resentments and blame, the kind that makes me dislike political parties so much.”

Which is, you know, pretty much par for the course for her. These allies of hers, if anything, tend toward even sillier rhetoric:

“We’re calling on James Clyburn to do the right thing and immediately drop his affiliation with the Wall Street-backed Third Way…”

“Wall Street-backed” being a very powerful epithet among these people. Because, apparently, business is evil by its very nature in their belief system.

It’s interesting to me that, just as John Boehner is finally reining in the loonies in his party — and they’ve been on quite a rampage for several years now — the left wing of the Democratic Party is going on a delusional tear of its own.

The only way this embrace of Sen. Warren as presidential timber for 2016 makes sense for Democrats is that it would provide Hillary Clinton with a way of looking sensible and mainstream by contrast (which she is, by contrast), putting her in a strong position for the general election.

But I don’t think these folks are thinking that way. I think they actually believe Sen. Warren represents a direction in which they can pull the country. Hence my use of the word, “delusional.”

First, we hear that Andre Bauer is thinking again about running for governor, this time as a third-party candidate (this is not what the UnParty had in mind!).

Now, we see USC’s football star is making like the ex-lt.gov. (except that, unlike Mr. Bauer, he was charged):

South Carolina defensive end Jadeveon Clowney was cited by the South Carolina Highway Patrol for speeding Saturday for driving 40 miles per hour over the posted speed limit,according to WIS-TV.

Clowney, according to the report, was going 110 miles per hour in a Chrysler 300 when he was pulled over on Interstate 77 Saturday night around 7:30 p.m. The highway’s listed speed limit is 70 miles per hour.

Officials say he was immediately ticketed and that no other citations were issued in the incident….

Nor, apparently, was he arrested at the scene.

This year’s One Book: Conroy’s “My Reading Life”

Last night, I dropped by Richland Library for the unveiling of the chosen book for the 2014 “One Book” program.

It’s My Reading Life, by Pat Conroy. Everyone was pretty pumped about it, in part because the author himself will be participating in the program.conroy

I look forward to reading it myself, and joining in discussions of it. As you may recall, I moderated a discussion at the library for this past year’s selection, A.J. Mayhew’s The Dry Grass of August, a book I enjoyed much more than I had thought I would.

Which I suppose is kinda the point of participating in a program that gets you to read something you might not have. It’s broadening to get pulled away, however briefly, from my obsessive re-reading of Patrick O’Brian’s Aubrey-Maturin series (I’m currently on about my sixth trip through some of the books — I still haven’t allowed myself to read the very last two in the series).

Now, to digress…

After the announcement, I got involved in a discussion of the strong-mayor referendum with Mike Miller, Tim Conroy (the author’s brother and a longtime Columbian), and City Councilman Sam Davis. All of us, except Mr. Davis, had been deeply disappointed by the outcome. He listened patiently to us, and we listened patiently to him, but I don’t think any minds were changed.

We were joined late in the discussion by our old blog friend James D. McAllister, a writer and owner of Loose Lucy’s. He was against strong-mayor, but Kathryn would probably discount his opinion, since, like me, he doesn’t live in the de jure city.

Anyway, back to the book… maybe we should all read it and have a good discussion of it here on the blog. Whaddya think?

The Shandonistas strike back: Strong-mayor was stopped by insiders. Again.

During a lively discussion on a previous post, Phillip Bush wrote:

You should be happy, Brad. The State’s article today alluded to the “unusual bedfellows” who were joined in opposition to this measure, it crossed all sorts of party/ideology lines. (For that matter, so did the Yes side)….

In reply to that, and in response to a comment from Kathryn Fenner about us “outsiders” who wanted the change, I wrote the following (and then decided it should be a separate post rather than a comment)…

Oh, DANG! In copying the above comment from Phillip, I lost it! OK, I’ll try to reconstruct it…

This reform was defeated by insiders, no question about it. Insiders who managed to persuade a majority of the few who turned out to vote with them. So congratulations to them for winning. Again. The strategy of having a completely unnecessary extra election in order to separate the issue from the re-election of a popular mayor worked. (The idea that an extra month was needed for discernment, after all these years of discussion, was risible.)

But as for the idea that I should be happy…

It’s facile to say, look, there are Democrats and Republicans, black and white people, working together on this. Those are granfalloons, within this context. As I’m sure Bokonon would tell you if he lived here, as meaningless as granfalloons can be the rest of the time, they are particularly irrelevant to a city election in Columbia. The group I saw aligned against this was, to my eye, homogeneous — a true karass, to keep the Vonnegut theme going.

This was, on one level, a case of the Shandonistas striking back. Look at the chief apostles of “No,” who celebrated their victory in the ultimate Columbia insider salon: Kit Smith’s house. Kit herself, Howard Duvall, Rusty DePass, Tameika Devine, Moe Baddourah (a relative newcomer to insiderism, but a very quick study — he changed his mind on strong mayor between the day he was elected and his very first council meeting).

Am I saying these are bad people? Absolutely not. I like and respect all of them. The kind of insider I’m talking about is generally someone who has given much to the community. These are good, dedicated people. But as I say, they have gained, I’ll even say earned, a certain access — through election, or through years of volunteer advocacy — to the current power structure.

Now, the power structure that exists is a feeble thing. It moves slowly and ponderously, and is far better at stopping things from happening than at making them happen. But it is power, and it’s the kind these folks have access to. Power that, let me hasten again to add, all of them want to use for good. But whether you want to do good or ill, in politics, you “dance with the one that brung you.” And this system is the one that “brung” these folks to the point of being able to achieve whatever they have accomplished thus far. They are invested in it.

Meanwhile, strong-mayor is a more open, less controllable, broader, more dynamic system. Empowering a chief executive who has a mandate from a majority of voters increases volatility, makes it more likely that things will happen. Those of us who have enough faith in democracy to believe enough good things will happen to outweigh the bad — and believe in the power of greater transparency (which is a feature of strong-mayor) to correct the bad — tend to favor it. Those who fear the bad that can happen tend to oppose it — especially when they themselves have access to the keys that can occasionally move the present, slower, less dynamic, more conservative system.

Strong-mayor — and Steve Benjamin himself — represent a broader view of what Columbia is and can be, a view that includes all of us who live in the de facto city, all of us whose destinies are tied up with it. Those with a narrower view — who can speak in terms of “them” telling “us” how to run “our” town — will reject it. To them, it’s just far too risky. Interests that don’t have their acutely-tuned sense of the community’s good might have an impact on what happens, and that’s just too uncomfortable.

Phillip says I’m wrong to equate this with the Legislature’s ongoing refusal to empower the executive (and thereby the people who elected the executive). Perhaps he’s right, but I don’t think so. I’ve been here before. When we did the Power Failure series back in the early 90s (which advocated for local reforms as well as statewide ones), I noticed how many really good, smart, dedicated people who cared deeply about South Carolina — officeholders, political operatives, lobbyists for idealistic nonprofits, and so on — reacted negatively to what we were writing. I thought a lot of most of these people. They were people I’d like to have arguing for these reforms rather than against. They were important influencers. So we hosted a series of luncheons — about 30 people at a time — consisting of these vocal opponents, to address their questions and explain why we were doing this. But with most of them, I had trouble selling our idea of cluing the Great Unwashed out there into why South Carolina didn’t work better than it did. And that’s because all of these people had learned to move this system as well as it could be moved, although in limited ways. They knew how things worked, to the extent that they worked, and many of them believed that was enough.

Bottom line, many smart people will see diversity in the successful opposition. But I see what the chief opponents had in common more clearly than their differences.

How did YOU vote on strong mayor, and why?

This is just for our de jure city dwellers, as opposed to those of us who live in the de facto city, but don’t get to vote on its governance. (Or pay the taxes. Or get the services.)

So how did y’all vote? I’d like to compare my readership to the actual citywide vote.

Columbia Firefighter’s Association backs Yes Vote on Strong Mayor

COLUMBIA, SC — The Columbia Firefighter’s Association announced on Tuesday that they are urging Columbia residents to vote yes for modern strong mayor form of government that will give the Mayor Columbia the authority needed to ensure public safety is a top priority.

Anthony Holloway, President of the Columbia Firefighters Association, explained his organization’s decision to back the strong mayor system:

Our city is at a crossroads and we have a tremendous decision to make today: change or more of the same.  We know first hand that the present system is holding our first responders back.  That’s why we hope Columbia voters will vote yes for a safer city and a more accountable government.

The fire service has been struggling with an attrition problem for years — a problem that is only getting worse.  Despite the genuine efforts of many in the fire department and the city government, most days there are fire trucks that are under-staffed or taken out of service simply because we don’t have enough firefighters on staff.

The attrition issue and many other concerns facing our city’s firefighters could have been resolved by now if the mayor had the authority to act. But under the present system, important decisions often get deferred and no one is held responsible for the consequences. A strong mayor system would fix that.

Mayor Benjamin is standing up and saying “I will be responsible.” That is a bold move that we fully support.

And so the firefighters join the Columbia Chapter of the Southern States Police Benevolence Association in favoring reform.

 

Rep. James Smith on why he’s for strong-mayor

Here’s a release I received today from Rep. James Smith:

There are many good people who care about the future of the City of Columbia on both sides of the debate about our city’s form of government.  Please allow me to tell you why I’m VOTING YES for a Strong Mayor tomorrowand I hope you will too.

Columbia is fortunate to be served by a dedicated and conscientious City Council and city staff who do their best to serve us every day.  But I believe our city is hindered by a system that lacks the fundamental elements of accountability that are the bedrock of our Democracy.JES_post_pic

We know this issue has been debated and discussed for the better part of two decades. We know this is the most popular form of government in South Carolina and the same model used by our state and federal governments.  And we know the only reason we have this chance to adopt a more effective and accountable Strong Mayor form of government is because over 12,000 individuals just like you who signed a petition and demanded the right to vote.

Some in opposition want to make this about politics and power.  But the simple truth is that City Council’s authority doesn’t change at all and a Strong Mayor would have no more power than the City Manager has right now.  The only difference is that you hire the Mayor and you can fire the Mayor.  The same can’t be said of the City Manager.

The Mayor answers to you and it doesn’t matter how many petitions you sign or how loudly you protest, the City Manager never will.  That’s the only difference… but it makes all the difference.

  • When the city comes to edge of bankruptcy and no one is held accountable, the system is broken.
  • When no one takes responsibility for years of deferred water/sewer maintenance resulting in EPA intervention and rate increases, the system is broken.
  • When the police chief can’t do his job without getting permission from an Assistant City Manager, City Manager, any number of department heads and a panel of politicians, the system is broken.
  • When the red tape keeps the Mayor you elected from doing what you elected him to, the system is definitely broken.

We need to fix it.

This is our chance to make a real difference, to step forward into a new and more effective government and build the Columbia we’ve always dreamed of.

This is our moment. Tomorrow, December 3, Vote YES for accountability. Vote YES for safety. Vote YES for change and for a greater Columbia.

We’ve been on hold long enough.  Let’s move forward together.

Haley’s backing of strong-mayor shows laudable consistency

Still catching up with news from over the long weekend. I was fighting a cold, and did not leave the house from Wednesday afternoon until this morning. Nor did I blog (did ya notice?) or even read news, which might have tempted me to blog, which I did not feel up to (or, as the pedants would have it, up to which I did not feel).

So I’m only now reacting to this:

Gov. Nikki Haley has come out in support of Columbia’s strong mayor referendum, which will be decided on Tuesday, after discussing the issue with Mayor Steve Benjamin.

A mailer explaining her position was sent to residents late this week.

“After talking to Mayor Benjamin, Governor Haley was happy to lend her support,” said Rob Godfrey, a spokesman for Haley, in a statement. “The governor has long believed in restructuring government to produce accountability and efficiency for the people it serves — not just in state government, but at every level of government.”…

Good for her. As you may know, government restructuring is one of those subjects on which our present governor and I agree, since I have advocated the commonsense notion of actually putting the elected chief executive in charge of the executive branch since she was in school.

And I’ve favored a strong-mayor system for Columbia just about as long. The idea arises from the same principle: putting the day-to-day government in the hands of someone chosen by the voters, rather than in the hands of a hired manager who answers neither to the people nor to any single, accountable individual.

So I’m glad Mayor Benjamin reached out to Gov. Haley, and I’m glad she responded so positively and sensibly.

TV ad probably not best medium for strong-mayor pitch

Not that there’s anything in particular wrong with it. It’s just that the medium forces oversimplification.

It does hit the accountability issue, which is key. But helping people understand how a strong mayor is more accountable takes explanation.

Absurdly, opponents of reform have tried to claim that a city manager is more accountable. Their argument is that the manager can be fired any time, rather than having to wait until re-election time.

That is rendered absurd by experience. No one who has seven equal bosses can be said to have a boss at all. Anyone recall how long it took city council even to do an evaluation of Charles Austin? I’m sort of asking, because I don’t recall the exact length of time myself. But it was outrageously long, reflecting how difficult it is for a body of seven people to agree on what direction and feedback a manager should receive.

And anyone who thinks an elected mayor is accountable only at election time hasn’t paid attention to the way elected officials actually behave, which is to look over their shoulders constantly to make sure the voters are happy with the job they’re doing.

Anyway, for what it’s worth, I pass on the advert.

Or are we looking at a broader pattern of incompetence in local elections?

As you know by now, 1,114 ballots went uncounted in Richland County in the recent election. Most who read The State‘s report this morning will have zeroed in on this part:

Jackson declined Thursday to say who was responsible for the error or what actions he might take.

He did acknowledge, however, that absentee balloting is the responsibility of his predecessor, Lillian McBride, who was demoted in the wake of last year’s county election debacle but given another position in the office. Still, he would not pin blame on anyone, characterizing the mistake as a “system” problem….

That part, and also the part where we’re told that the closed-door meeting of the Keystone Kops — I mean, the county Elections & Voter Registration Board — “focused primarily on personnel matters.”

Now let me pause for a moment to complain about the fact that in South Carolina in 2013, we have such a thing as public bodies meeting behind closed doors. When I was a reporter in Tennessee in the late 1970s, we had this thing called a “Sunshine Law,” and public business was done in public. I used to hear about the bad old days when there had been such things as “executive sessions,” and I was appalled at the thought.

Then, I moved home to South Carolina, where such things are still a fact of public life.

End of digression.

The chairman of the elections board acknowledges “glitches,” but tells us, “We feel that the election overall went good.”

Grammar aside, it’s not a statement that inspires much confidence.

Tim Scott, twice refusing to endorse senior colleague Graham

The State‘s new Buzz blog (I’m trying to remember whether this is the paper’s first serious attempt at a state and national political blog since I got laid off, but perhaps such reflections are ignoble of me) brought my attention to the above clip. Their account (like I’m gonna retype if it I don’t have to) of it:

U.S. Sen. Tim Scott passed twice on saying whether he would endorse his fellow S.C. senator, Republican Lindsey Graham, in an interview on CNN’s Crossfire Wednesday.

When CNN’s Van Jones asked Scott whether he would support Graham, Scott said, “You know, as you three have heard recently, I am up for re — up for reelection myself. I’m going to make sure that Tim Scott gets out…I’m going to allow for all the other folks on the ballot to represent themselves very well, and I’m going to continue to work hard for my re-election.”

“No endorsement for Lindsey Graham tonight?” Jones asked again.

Scott replied, “I’m certainly going to work really hard for Tim Scott re-election — gotta win first.”…

I sort of doubt that Sen. Graham’s going to be sitting up nights trying to think of favors he can do for Sen. Scott in the foreseeable future.

I was particularly struck by the way he stopped himself from saying “re-election,” then went ahead and said it anyway. The question seems to have had him pretty flustered…

Sheheen camp taking wrong approach on ethics, Haley

I have a limited patience with discussions of public ethics. It would take more words than I feel like writing today to explain all the reasons why, but here’s the simple explanation: I find that too often, in the political sphere, when we speak of “ethics,” we are not talking about right and wrong; we’re merely talking about appearances.

Cindi Scoppe has always had more patience with ethics discussions than I. That’s fortunate, because her patience and diligence has made her highly knowledgeable about the ways that the topic intersects with SC public life.

But even Cindi has lost patience with the way Vincent Sheheen’s campaign is talking about ethics this week. This excerpt from her column today begins with a quote from a Sheheen release:

“Today, Nikki Haley held a press conference to talk about ethics reform in South Carolina,” a news release from his gubernatorial campaign began. “From covering up the Social Security number hacking scandal to flying with campaign staffers in a state owned plane, Nikki is the last person who should be talking about ethics reform.”

Wow.

I suppose that sort of non sequitur makes some sense from a campaign perspective, as it reminds people of our governor’s ethical imperfections. But from a governing perspective — and one of the things that I’ve always admired about Vincent Sheheen is that he cares about governing, much more than the governor has tended to — it is completely wrong.

It suggests that reform should be pursued only by the pure of heart. In fact, our government, as a creation of human beings, must rely on imperfect vessels….

Cindi’s completely right. And she’s right that, while the ethics bill the governor is pushing has serious flaws, it’s better than no bill at all.

All week, the Sheheen campaign and state Democratic Party (mostly the party, now that I go back and look) have been bombarding my inbox with attacks on Nikki Haley’s suitability as an advocate for ethics reform.

Yep, it’s ironic that she wants to prevent abuses she has committed herself, but hey — at least she knows what she’s talking about.

And yes, the attacks on Sheheen for being a small-town lawyer representing clients before magistrates whom he had recommended for appointment are rather absurd and over-the-top. As the Sheheen campaign notes, he is the sponsor of a bill to place the power for appointing magistrates in the hands of the Supreme Court. There is nothing “scandalous,” to cite one word used by the governor’s staff, about him representing clients openly in magistrate’s court, under the laws currently in place.

I am more disturbed that so much rhetoric out of the Sheheen campaign and its allies is about tearing down the governor.

In other words, Doug, I’m moving to your way of thinking. I have defended Sheheen to Doug, saying that when you’re running against an incumbent, you have an obligation to explain to voters why the incumbent should no longer hold the office. This necessity is less obvious to Doug because his more or less default position is to be anti-incumbent, while I expect a challenger to justify the challenge.

One justifies a challenge in two ways: By explaining what’s wrong with the incumbent, and by telling voters why you, the challenger, would do a better job.

Lately, though, it seems the Sheheen campaign is all about the former, and very light on the latter.

To get back to Cindi’s column:

The email went on: “Our state deserves real ethics reform. And we deserve a governor who doesn’t constantly blur the lines to serve political agendas.”

Those are both very good points. But they address two completely different issues.

The first is about what sort of law the Legislature passes — or doesn’t pass — in the coming session. The second is about whom we elect as governor a year from now.

Personally, I’d like to have both. At this point, I think Mr. Sheheen would make a better choice on the “governor who doesn’t constantly blur the lines” thing. And the ethics plan that Ms. Haley is pushing might be our best shot at real ethics reform. In fact, while Mr. Sheheen wants to focus more on correcting other shortcomings in our ethics law, the main provisions that Ms. Haley is pushing are changes he supports.

One of the things I detest about our two dominant political parties is the way they encourage people to attack good ideas just because they come from the other side. The Sheheen campaign seems to be falling into that habit, and should heed what Cindi said at the end:

Yes, we deserve a lot better than the Senate Judiciary Committee’s reform package. But the way to get better is to join with other reformers to strengthen the bill — not to attack the efforts of the person who’s best able to focus public attention on the need for reform.

Don’t make perfection the enemy of the good (this is cracking Cindi up, because she had to say that so often to me, as I was seldom satisfied with half a loaf). Take a mediocre bill, and work to make it better.

And cut it out with the drip, drip, drip of negativity.

Last night at the annual meeting of the City Center Partnership in the Tapp’s Arts Center, Columbia’s just-re-elected mayor got up to speak, and urged those present to address him henceforth as Steve “Landslide” Benjamin.

Yes, it was a joke. Everybody laughed. (Although when it was mentioned at another meeting I attended today over lunch, mayoral aide Sam Johnson said yeah, he was trying to discourage “Landslide” from calling himself that. Also joking. I think.)

Over at ADCO, we were particularly pleased to see the above cover on last week’s Free Times. On account of, you know, we came up with “Famously Hot.” I really enjoy the fun that Free Times has with the brand, such as on this cover last year.

Another primary opponent for Graham: Bill Connor

Bill Connor is still playing it rather coy with his Facebook peeps:

Friends, I have a major announcement to make on Monday, but this weekend I plan to focus on military obligations (spending time with my Citadel teaching team) and spending the other time with my family. I appreciate that many calls and texts, and e-mails and will be in touch with everyone next week. But The State reports that he’s actually already filed:

Orangeburg attorney Bill Connor, who lost the 2010 Republican runoff for lieutenant governor to Ken Ard, has filed to run against U.S. Sen. Lindsey Graham in next June’s Republican primary, according to federal election documents.

Connor becomes the fourth Republican to oppose Graham in the primary, joining state Sen. Lee Bright of Spartanburg, Easley businessman Richard Cash and Charleston public-relations executive Nancy Mace…

When I saw him a couple of weeks back, Lindsey Graham indicated that as far as he was concerned, he loved having three opponents.

But four could be one too many. Also, i think he has a little more reason to worry about Bill Connor than about the others who have previously jumped into the ring.

He’s a somewhat more traditional conservative than his opponents — more the values-voter, God-and-Country type than the SC-should-print-its-own-money-again sort. Or at least, in the statements I’ve seen so far. He’s paid some dues in the party, currently serving as the 6th-District chairman. He’s got a solid military record, having served in a combat role in Afghanistan. He’s run a statewide primary race before (losing the lieutenant governor nomination to Ken Ard). And he’s just gone out and had new portraits taken of his family. (I still remember how deeply impressed John Courson was when Mark Sanford sent out family portraits as Christmas cards before running for governor: “Fine-looking family — Kennedyesque… Kennedyesque!” You have to imagine it in Courson’s distinctive voice and accent.)

Lt. Col. Connor could be a more likely vote-getter. That doesn’t mean the incumbent’s in trouble. But it does make things a little more interesting.

Cindi’s thoughtful piece on SC chief justice contest

Someone was praising Cindi Scoppe’s column today on the contested election for chief justice of the SC Supreme Court, and I agreed: “Yes — Cindi’s probably the only journalist in SC who knows enough even to have the idea of writing it.”

You may be disappointed after that buildup to find that there’s no hard-hitting, simple editorial point in the piece, and she certainly doesn’t take sides between incumbent Jean Toal and challenger Costa Pleicones. The overall point is to lament the system we have for picking justices, and the lack of transparency in it after that one, brief, qualification hearing — which everyone knew that both of these exceptional jurists would pass with flying colors.

What she does is provide perspective on the court and its place in our, um, unusual system in South Carolina.The piece should be required reading for legislators, who will be the voters in this particular election.

The piece does a number of things. First, she explains that this is yet another chapter in Jean Toal’s precedent-breaking career, and I don’t (and she doesn’t) mean that in the facile sense of trailblazer for women, yadda-yadda:

But things never have been normal where Jean Toal is involved, and by that I’m not referring to the fact that she was South Carolina’s first female justice and chief justice.

In 1988, she became the first non-judge elected to the high court in more than three decades. That happened after ethics questions derailed the candidacy of Circuit Judge Rodney Peeples, who entered the race with more than enough votes sewed up to win.

Eight years later, Mrs. Toal became the first sitting justice since 1893 to be opposed for re-election, when Circuit Judge Tom Ervin challenged her amidst anti-tax groups’ absurd efforts to paint her as a liberal; her support was so overwhelming that he dropped out of the race less than two hours after legislators were allowed to start making commitments.

Now she’s the first chief justice since at least the 1800s to be opposed for re-election…

Clearly, the Legislature will break precedent if it elects Mr. Pleicones. But even if it re-elects Mrs. Toal, the status quo already has been interrupted, making it much easier for lawmakers to break with tradition and skip over Mr. Pleicones and, who knows, perhaps skip over Mr. Beatty, possibly even select a chief justice who isn’t on the court….

In future SC history books, there will likely be quite a few footnotes devoted to Jean Toal.

As I said, while this piece may be interesting to other readers, it should particularly be read by lawmakers. Cindi takes it on herself a lot to put things into perspective for legislators. Someone needs to.

One key thing she explains — and these days we have more and more lawmakers who need this explained — is that there are important issues at stake here, but they have nothing to do with notions of left and right, Democrat and Republican, the way those things are force-fed to us today out of the Beltway:

Some Republicans in the Legislature — and lots outside, particularly of what we now call the tea-party variety — have been grumbling for years about having a court full of former Democratic legislators.

I suppose it’s understandable that people would be confused about the role that partisan politics plays on the S.C. Supreme Court — none — given the diet of hyperpartisan Washington politics on which a frightening number of South Carolinians feed, forming not only their world views but their state views.

Although the U.S. Supreme Court is in fact composed of two well-defined ideologies, you’d be hard-pressed reading state Supreme Court decisions to guess the partisan or ideological inclinations of the justices. So I was a little disappointed when Justice Toal, asked about complaints that she’s too “political,” dismissed them by noting how well she has gotten along with the Legislature and governors, even as their politics have changed.

The political temptation Supreme Court justices face has nothing to do with party or ideology. It is the temptation to kowtow to the Legislature, whatever the Legislature’s partisan leanings or political philosophy. It’s to look the other way when the Legislature tramples on our state constitution. It’s to pretend that the laws say what the Legislature meant them to say rather than what they actually say.

That temptation must be greatest for the chief justice, whose dual role as chief executive officer of the entire judicial branch of government brings with it the heavy burden of convincing the Legislature to fund the courts adequately, and keeping lawmakers from exacting retribution, financial or otherwise, when court decisions go a way they don’t like…

It is for this reason that Cindi laments that “Justice Toal, asked about complaints that she’s too ‘political,’ dismissed them by noting how well she has gotten along with the Legislature and governors, even as their politics have changed.”

And of course, in SC, things get very personal, as Cindi suggests in suggesting an apparent reason why Associate Justice Pleicones is making this extraordinary challenge to his old friend:

… one of the themes of criticism that Justice Toal received in anonymous surveys from lawyers stemmed from what Justice Pleicones has called her broken promise to retire when her term ends next year, which would give him an extra year and a half as chief justice….

In the end, the main concern expressed is that from here on, we won’t know what these candidates are saying to individual electors: “For the mind reels at where even the most honest and well-intentioned justices might be tempted to go when they meet behind closed doors with legislators who have votes to provide them — and requests to make of them.”

Cindi doesn’t mean to besmirch either candidate. She notes in particular how Jean Toal’s tenure has been characterized by a “steady move toward judicial independence, toward calling out the Legislature when it needs to be called out.”

But moments such as this create enormous potential for undermining that kind of essential independence. And that is indeed disturbing.

Hmm… Does Graham WANT Christie to campaign for him?

This morning, the national buzz is all about Chris Christie having positioned himself so well for the presidency in 2016. The talk is so far along that I couldn’t resist joking:

But the very qualities that make Christie attractive as a general-election candidate (Republicans are fairly swooning over his getting 51 percent of the Latino vote) get him in trouble with the national GOP base. Most of it is silly, symbolic stuff, such as his making nice with President Obama (you know, the guy who was rushing billions in aid toward his state) after the hurricane. But you know how the base (in each of the parties) can be about the silly, symbolic stuff.

In fact, the reservations harbored by many of the people who, had they been in Virginia, would have voted for Ken Cuccinelli are such that I find myself wondering about this:

Sen. Lindsey Graham’s (R-SC) re-election bid will evidently get a lift from one of the most popular governors in the country and a top 2016 contender….

According to the Times, Christie informed Republicans in South Carolina he intends to go to bat for Graham, who is facing a GOP primary next year.

poll released last week showed Graham’s approval rating taking a big hit in South Carolina, including a steep drop among GOP voters. …

Yeahhh… that’s the thing. The GOP voters who are mad at Graham are likely to be the ones least charmed by Christie.

So, I ask — is Christie coming here a plus or a minus for Graham? Thoughts?

Would Halfacre be good candidate for McLeese job?

This morning, I was talking with a Lexington county politico about Lexington Mayor Randy Halfacre’s re-election loss yesterday — we were both surprised, in varying degrees, at that outcome.Neither of us knew enough about the winner, Councilman Steve MacDougall, to have a clear idea of what happens next in the town.

Then, as has been the trend in such conversations the last couple of weeks, we talked about all the prominent deaths the Midlands have suffered.

I said, yeah, with Ike McLeese gone and Halfacre out as mayor, that’s two losses among advocates for regional cooperation.

My interlocutor reminded me that Randy Halfacre is still the head of the Lexington Chamber of Commerce. Then he added, “Who knows? Maybe he’ll come over here.” (We were standing in downtown Columbia as he said it.)

I found that intriguing: What if Halfacre were to become McLeese’s successor? There’s a certain logic to it. They were close allies, and he’s already invested in Ike’s regional initiatives — in fact, he has led them.

Halfacre was one of the four — along with Columbia Mayor Steve Benjamin, retired Maj. Gen. Abraham Turner and USC Athletic Director Ray Tanner — who eulogized McLeese at the Friday funeral. He told the story of how Ike was the one to realize that the region had to get its act together after it lost Southwest Airlines to Greenville and Charleston. He asked Halfacre to lunch, and proposed that local chambers needed to work in a coordinated manner going forward. Halfacre said sure, he’d help Ike any way he could. Ike said no, you misunderstand: You’re going to lead it, because it won’t work if it’s seen as Columbia asserting hegemony over the region. So he did.

Anyway, given that history, it’s an intriguing idea, now that Halfacre is no longer to be mayor of Lexington.

I have spoken to no one in a position to know whether Halfacre is, or might be in the future, under consideration for the job. Or whether he should be. I just found it to be an interesting suggestion…

The big weakness in Sheheen’s hacking-outrage strategy

To mark the anniversary of the hacking scandal (remember that? turns out that most South Carolinians had their identities stolen due to the fecklessness of the state Department of Revenue), Vincent Sheheen put out a press release giving incumbent Gov. Nikki Haley hell about it:

The hacking was a horrible and preventable disgrace. First, under Nikki Haley, South Carolina’s Department of Revenue failed to enroll in the most basic protection services available that act as a first step in protection for other agencies and states around the nation. Second, a key cyber security director position at her Dept of Revenue was left vacant for a year while Governor Haley rewarded her campaign staff with other jobs they had little experience for in the administration. Third, the person in the cybersecurity position had quit prior to the hacking due to frustration that his repeated warnings about the vulnerability of the Dept of Revenue went unheeded by Nikki Haley and her closest advisers.
The hacking was a tragedy, and it was preventable. With different leadership and real accountability, we will do better. South Carolina could have been better prepared to withstand the hacking attempts, like other states, and not become a target because of the major holes in our cyber security that were ignored by the Haley administration despite multiple warnings.
By covering-up the hacking for 16 days, Nikki Haley failed the test of leadership. After learning that millions of people in our state had been exposed to great risk under her watch, Nikki Haley’s first instinct was to cover it up. She waited more than two weeks, hired a lawyer, lined up her public relations firm, and covered her tail before deciding it was the right time to let the people she was elected to serve know they were at risk. Then, when she did finally break the news, the story was ever-changing as she flip-flopped back and forth trying to paint a rosier picture. First she said nothing could have been done to prevent it. That wasn’t true. Then she said that no businesses were affected. That wasn’t true. Then she said no children were affected, that wasn’t true. …

And so forth. The State called Sheheen’s letter on the subject “scathing.” Chris Haire of the Charleston City Paper called it “devastating.” (Of course, he also said there’s no way Sheheen is beating Haley next year, which would mean the gov is likely to be less than devastated.)

But there’s just one problem with this strategy for tapping voter ire on this subject — I’m seeing a distinct lack of voter ire.

Maybe y’all have seen something else; I don’t know. If so, report in. Let me know about it.

But my impression is that most of us have been waiting around for a year to see whether this thing is going to have any impact on our lives.

We’ve been waiting for the other shoe to drop. Or maybe even for the first shoe to drop, depending on how you read the metaphor.

The end of Seanna Adcox’s story for The Associated Press sort of explains why we’re not all seizing pitchforks and torches and marching toward the governor’s mansion:

Sheheen touted his work in helping create an Identity Theft Reimbursement Fund in the state budget. The largely symbolic program calls for the state to reimburse expenses that an identity theft victim incurs because of a state breach. Someone seeking money would have to apply to the state treasurer’s office.

As of Tuesday, no one had, according to Treasurer Curtis Loftis’ office.

It’s unknown if anyone’s identity has been stolen because of the hacking. A Federal Trade Commission attorney has said the selling and trading of stolen information makes it virtually impossible to trace an identity theft case to any particular security breach.

Yeahhhhh. OK. Well….

If a bunch of us start feeling the effects of this ID theft, and think we have reason to blame it on negligence by the Haley administration, then maybe the Democrat will have some resentment to tap into. But so far, not so much.

So what’s Sheheen’s plan B?
