Going after the stimulus

WOLF BLITZER: Should South Carolina take the money?
GRAHAM: I think that, yes, from my point of view, I — you don’t want to be crazy here. I mean, if there’s going to be money on the table that will help my state….

LINDSEY Graham said that in spite of his strong opposition to the stimulus bill as passed. His aide Kevin Bishop explained the senator’s position this way: “South Carolina accepts the money, future generations of South Carolinians are responsible for paying it back. South Carolina refuses the money, future generations of South Carolinians are still responsible for paying it back.”
    Good point. And now it’s time to think about how South Carolina gets its share.
    A number of local leaders were already thinking about, and working on, that issue while debate raged in Washington. Columbia Mayor Bob Coble and University of South Carolina President Harris Pastides led a group of local leaders who came to see us about that last week. (It included Paul Livingston of Richland County Council; Neil McLean of EngenuitySC; John Lumpkin of NAI Avant; Tameika Isaac Devine of Columbia City Council; John Parks of USC Innovista; Bill Boyd of the Waterfront Steering Committee; Judith Davis of BlueCross BlueShield; Ike McLeese of the Greater Columbia Chamber of Commerce; and attorney Kyle Michel.)
    The group, dubbed the “Sustainability and Green Jobs Initiative,” sees the stimulus as a chance to get funding for projects they have been promoting for the advancement of the Columbia area, from Innovista to riverfront development, from streetscaping to hydrogen power research.
    The idea is to make sure these local initiatives, which the group sees as synching perfectly with such national priorities as green energy and job creation, are included in the stimulus spending.
    Mayor Coble, who had already set up a “war room” in his office (President Pastides said he was setting up a similar operation at USC, concentrating on grant-writing) to track potential local projects and likely stimulus funding streams, saw little point in waiting around for the final version of the bill, saying we already knew what “90 percent” of it would be, whatever the conference committee came up with.
    Some specifics: Mayor Coble first mentions the North Main streetscaping project, which is already under way. President Obama wants shovel-ready projects? Well, says Mayor Bob, “The shovel’s already out there” on North Main. Stimulus funding would ensure the project could be completed without interruption.
    He said other city efforts that could be eligible for stimulus funds included fighting homelessness, extending broadband access to areas that don’t have it, hiring more police officers and helping them buy homes in the neighborhoods they serve.
    But the biggest potential seems to lie in the areas where the city and the university are trying to put our community on the cutting edge of new energy sources and green technology. With the city about to host the 2009 National Hydrogen Association Conference and Hydrogen Expo, Columbia couldn’t be in a better position to attract stimulus resources related to that priority.
    The group was asked to what extent Gov. Mark Sanford’s opposition to stimulus funds flowing to our state created an obstacle to their efforts. “There’s no use arguing with the governor,” the mayor said. But the local group’s efforts will be focused on being ready when an opportunity for funding does come — whether via Rep. James Clyburn’s legislative end-run, or through federal agencies, or by whatever means.
President Pastides says, “The governor has deeply held beliefs and philosophies and I respect him not only for having them,” but for being straight about it and not just telling people what they want to hear. At the same time, with the university looking at cutting 300 jobs and holding open almost every vacancy, “there are almost no lifelines for me to turn to” to sustain the university’s missions. An opportunity such as the stimulus must be seized. He sees opportunities in energy, basic science and biomedical research.
    As big as the stakes are for the Midlands regarding the stimulus itself, there are larger implications.
    A successful local effort within the stimulus context could be just the beginning of a highly rewarding partnership with Washington, suggested attorney Kyle Michel, who handles governmental relations for EngenuitySC. He noted that many provisions in the stimulus are the thin end of the wedge on broader Obama goals. This is particularly true of the effort toward “transitioning us away from… getting our energy from the people who are shooting at us,” which he describes as the administration’s highest goal. “What are we going to do over the next four years to play our part in that goal of the Obama administration? Because this 43 or 49 billion is just the start.”
    He also said what should be obvious by now: “If we don’t draw that money down… it doesn’t go back to the taxpayer. It goes to other states.”
    President Pastides said, “This is almost like someone has announced a race with a really big prize at the end,” and you don’t win the prize just for entering; you have to compete. That appeals to him, and he’s eager for the university and the community to show what they can do.
    This group is focused less on the ideological battle in which our governor is engaged, and more on the practical benefits for this part of South Carolina. It’s good to know that someone is.

Differing views on the stimulus

Just to share with you some of the e-mail that I ran through just before leaving the office for the night, here are three views on the stimulus bill that passed the House today.

     “The last time our country faced an economic crisis of this magnitude, the government’s response in large measure omitted the communities that I represent and for which the NAACP advocates.  As we crafted the American Recovery and Reinvestment Act, we targeted our efforts on traditionally underserved communities and rural communities using census tracks and poverty levels to direct the greatest need. I believe we met the challenge put forward by the NAACP for equity and fairness, and I expect this recovery package to deliver the hand-up that Americans so desperately need.
     “The American Recovery and Reinvestment act makes targeted investments so the children in Sumter, South Carolina will have clean-water, so that children at J.V. Martin Junior High School in Dillon, South Carolina will not have to learn in a 150 year old school, so that the mother in Charleston, South Carolina will not be homeless, so that kids Columbia, South Carolina will have a summer job,  so that a teacher in Anderson Primary School in Williamsburg, South Carolina will not lose their job, and so that families in Florence, South Carolina looking for a way-out out this economic recession will not suffer under a Governor’s political ideology.”

We’re spending $1.1 trillion over the next ten years and we never had a
thoughtful discussion to figure out how we could come together on something with
bipartisan support.  The idea that this is bipartisanship does not meet any
realistic test of bipartisanship.

Lack of Job Creation
Provisions:

“About seventy percent of the jobs in our nation are
created by small business.  If our goal was to crate jobs and stimulate the
economy, one of the tests should be how much did we do for small business?  Not
much.  Less than $3 billion in the entire package is directed to small
business.  It’s one of the areas of the bill where the focus missed the target
by a country mile. 

Untimely Spending to Create Jobs and
Stimulate the Economy:

“There are so many things in the package completely
unrelated to creating a job in the next 18 months.  Only 11 percent of the
appropriated spending will be spent in the first year.  In fact, over half of
the money will not be spent until two years from now.  We waste money in this
bill that could have gone to shoring up the financial sector and fixing our
housing problems.”

Sheriff Lott back in the day




This previous post got me to thinking that some of you might be interested in traveling down memory lane a bit with regard to Sheriff Leon Lott, since he's recently become nationally famous.

As y'all know, I feel a certain kinship for the sheriff (whom we endorsed in the last election). We call each other "twin" because we were both born on the same day in the same year in South Carolina. Also, he has been named "Toughest Cop"
twice, and if there were such a thing as a "Toughest Editorial Geek" contest, y'all know I would have won it at least twice by now. (He's also won the Miss Vista Queen drag pageant, but there I can draw no parallels to myself. It seems we are not identical twins.)

As for the controversy in which he is currently engaged, I'm not as stirred up as a lot of folks one way or the other. I sort of go back and forth on it. I think the law should be enforced equitably — but I also wonder how many people who were not white and famous have been prosecuted when they weren't at the very least caught holding. I most emphatically do NOT agree with the folks who see this as evidence that the War on Drugs is stupid or useless or whatever. I think it's a good thing this stuff is illegal. But I also doubt that this particular case is really worth the resources devoted to it thus far.

Anyway, wherever you stand on all of this, I thought I'd provide this reminder that Leon has never been shy about going after people who break our drug laws. He's devoted a career to it, done it with a great deal of dash, panache and personal courage, and has often been controversial.

Here is a profile Clif LeBlanc wrote for The State when Leon was on the way to unseating his ex-boss as sheriff. I pulled and scanned some photos from our pre-electronic files by way of illustration.

Editor's note: This is the second of two articles examining the candidates for Richland County sheriff.

Leon Lott lives to catch the bad guys. He revels in the nitty-gritty and the glitz of being a cop. He may like it a little too much.

The 43-year-old Democratic challenger in Tuesday's election for Richland County sheriff believes in working hard and getting his hands dirty.

The way he went about busting pushers and users earned him a reputation and awards. But his boss, the incumbent sheriff, said it cost Lott the job he loves.

The long hours he put in as a narcotics detective for nine years also claimed his marriage and hurt his relationships with his daughters.

Nearly four years after reaching the depths of his personal and professional life, Lott feels he is a better officer who has grown enough to become the forward-looking "sheriff for the 21st century."

Dirty Harry and Sonny Crockett were personas Lott once wore with relish during high-flying days when he drove seized Porsches, sported an 18-carat Rolex, worked choice undercover cases with federal agents in Florida and postured for cameras.

Now he blames the Hollywood image on the media, though his best friend admits Lott enjoyed playing the role to his advantage. Lott still wears the $2,650 watch.

Citizens or celluloid? Lott has been chief of the tiny St. Matthews Police Department for three years. That has helped him appreciate real-life role models.

"I see myself as a combination of Frank Powell, Chief Austin as far as PR, and Sheriff Wells as far
as being involved in investigations."

Powell is the former five-term sheriff of Richland County who hired Lott in 1973 and has come to epitomize, for Lott, the lawman unswayed by political influence.

Chief Charles P. Austin is known for his ability to sell the community policing philosophy that has brought him and the city of Columbia success.

Union County Sheriff Howard Wells won national recognition for his handling of the Susan Smith case.

But Lott's critics don't buy that he is anything but the hot-dog narc who fashioned himself after make-believe cops and tried to live by rules that work only on the screen.

"He actually thinks he's Don Johnson. He actually thinks this is 'Miami Vice,' " said GOP opponent Allen Sloan, refering to the freewheeling fictional narcotics officer from the TV police drama that ended in 1989.

"That still exists today," Sloan said of Lott. "All the rules apply, except to Leon."

Two law enforcement officials who worked years with Lott in Richland County share a similar concern.

"He has an ends-justify-the-means mentality," one said, requesting anonymity because he would have to collaborate with Lott if he wins the election. "That's frightening in any law enforcement officer and especially in the top person."

Lott says he is a college-educated professional who can breathe new life into a tradition-bound agency.

"I never considered myself a hot dog," Lott said, wearing a tie and chatting from an easy chair in his modest living room. "The Sonny Crockett thing … I think I fed off what the news media created. I turned it around and tried to use it to our advantage."

Lott's best friend, Jon Fins, said the brash label comes from people who don't know him.

"To me, Leon is a guy in sweats who works out real hard to stay in shape, grabs a sandwich at McDonald's and goes right back to work," said Fins, co-owner of an Assembly Street pawn shop where Lott bought his Rolex.

Fierce or fair? Lott's detractors say his zeal often overrides good judgment.

Just before Christmas 1987, for example, his aggresiveness got the best of him, said Jim Anders, then-5th Circuit solicitor and now a strong supporter of Sloan.

Anders produced a blistering order from a federal judge over the seizure of a new, black BMW convertible during a drug bust.

Judge Clyde Hamilton ordered the car returned to its owner and blasted the U.S. Attorney's office, the FBI and then-Capt. Lott of the sheriff's office. The judge cited "many irregularities" and "questionable motivations" for taking the BMW.

"Captain Lott's testimony raised the possibility that he had sought forfeiture … for an improper purpose, specifically to serve as his private vehicle," the judge's ruling said. It appeared, Hamilton said, that Lott wanted to drive the care to the FBI Academy in Quantico, Va.

Lott was scheduled to leave for coveted training at the prestigious academy in about the time the BMW was seized.

The car had only the remains of a marijuana joint, Anders said, adding he refused to seize the car because state law required a minimum of 10 pounds of pot before government could move to confiscate a vehicle used in the drug business.

"That's the kind of reckless behavior that I'm concerned about," Anders said. "It's less character than ability. A smart police officer doesn't get himself involved in cases like that."

Lott's explanation? "That's not pointing any finger at me. It's pointing fingers at the Richland County Sheriff's Department, the Federal Bureau of Investigation and the U.S. Attorney's office. They made the decisions to move forward. I didn't force them to do that."

But Lott initiated the seizure and pressured the young woman who owned the car to voluntarily turn it over for forfeiture.

Caught in middle? Lott's most publicized criticism as a narcotics agent occurred in 1991. A circuit court judge threatened him with contempt for changing agreements with drug suspects, for ignoring a court order to arrest a father- and-son drug-dealing team from Miami and especially for not adequately supervising drug peddlers who were out on bond so they could help police make cases.

Enrique and Fabian Valencia were busted at Owens Field in February 1990 with 11 pounds of cocaine. In exchange for reduced sentences laid out in written agreements, they pledged to help Lott lure bigger dealers into South Carolina.

Judge Carol Connor stung Lott for his actions, but didn't punish the pushers because they met their terms.

Anders said he doesn't remember the agreement and Sloan publicly backed Lott when the deal made news in March 1991.

Lott produced his records of the case, which show that Anders' chief narcotics prosecutor signed the agreement. A Feb. 19, 1991, memo from Lott to then-5th Circuit Solicitor Dick Harpootlian, who disavowed the deal after suceeding Anders, indicates that Sloan "had been advised of the situation."

Lott maintains he was caught in the middle between officials who made an agreement in writing and a new prosecutor and judge who took a different view after the fact.

"If I did violate it," Lott said of Connor's order. "It was with the approval of the sheriff."

Harpootlian was so concerned about Lott's judgment at the time that he announced he would review all his drug deals and recommended to Sloan that Lott be taken out of narcotics enforcement.

Sloan moved him to what Lott calls a do-nothing administrative position, where he stayed until he was fired in December 1992.

The demotion and dismissal was the bleakest time in Lott's life. His marriage fell apart during that time and he had to try to explain to his three daughters why he was out of the profession he loved.

It took Lott six months to land the chief's job with the seven-member St. Matthews department.

Harpootlian and Lott have made peace and the prosecutor-turned-defense-lawyer is backing Lott's campaign.

"I think Leon had a life-changing experience," Harpootlian said. "He lost his wife. He lost his job. He's somebody who realizes he's screwed up. He's matured. The guy's real talented. He gets up every morning wanting to be a cop."

Lott doesn't agree with all of that. "I don't think I made immature or bad decisions," he said.

But asked if he would OK the BMW and Valencia decisions if he were sheriff, Lott responded, "I would approve."

Lott conceded that he has changed and plans to continue his professional growth. "I guess age matures you. I feel like I'm a more rounded law enforcement officer now."

But controversy has followed Lott to St. Matthews.

Before the June primary, Lott ran afoul of the federal Hatch Act, which limits political activity by employees whose agencies get money from Washington. Federal officials said Lott should not run for office because as chief of the Calhoun County town he administered nearly $59,000 in federal grants.

The dispute was settled this month after Lott agreed to drop the title of chief and sever any ties to supervision of the grants. But Lott remains chief in every other way after the town named him police "administrator."

Lott has built his campaign on the theme of higher standards. He said he will be fairer, he has the energy to be an administrator as well as a street cop, and he has fresher ideas.

He promises a network of 24-hour, full-service substations, a lower crime rate and all without a tax increase

The making of a cop. Lott fell into a career in law enforcement. More accurately, he threw himself into the job.

It was a boring summer evening just before his senior year at Aiken High School. Lott and some friends decided to egg cars from an overpass on I-20, which was under construction.

"I think the first car we egged stopped. We had egged the chief investigator for the sheriff's department," Lott recalled. "Me, being a (baseball) player … I had been the only one to hit the car."

The teen-agers tried to get away, but the detective pulled them over. He didn't rough them up or charge them, but he did behave professionally as he called their parents.

"It made such an impression on me … it just grabbed a hold of me," Lott said. The job appealed to his sense of rooting for the underdog (crime victims), to his interest in untangling things that are puzzling and to his restlessness with monotony.

The work also served as an outlet for his competitiveness.

Lott is media savvy and at ease before cameras, having appeared dozens of times in local newspapers and TV as well as nationally on "America's Most Wanted." But that self-assured image clashes with the quiet, reserved teen-ager Lott said he was.

He finds it odd that he's called a hot dog now when that was the kind of athlete he disliked in high school. "I thought actions spoke louder than words," Lott said.

The words have been loud and harsh in the Sloan-Lott race.

"There's been a lot of talk that this is about revenge," Lott said. "It's not. When he fired me … he gave me a chance to go out and show – prove to myself – that I could be more than just a narcotics officer. I got my revenge by being successful, by showing I could be a chief.

"I want to come back to Richland County, personally, so I can see my kids everyday and, professionally, because I can do a better job."

Bad blood between Leon, Harpo?

Looking for something else, I happened to run into this old story from 1991. It's from Leon Lott's Miami Vice days as head of the narcotics squad of the sheriff's department. As many of you will remember, back then Leon had a rep as a bit of a cowboy (in addition to Sonny Crockett, Dirty Harry was invoked) who liked to kick down doors and drive hot, confiscated cars.

But what I had forgotten was that Dick Harpootlian — who was quoted in today's story being critical of Leon on behalf of his client, busted in connection with the Michael Phelps investigation — had such a beef with Leon back then, when Dick was the solicitor. Interesting back story. Don't miss the classic quote at the end from Leon: "I love narcotics." (OK, so maybe that's a little out of context.):

Richland County's vice Capt. Leon Lott, often compared to "Miami Vice" character Sonny Crockett, will be transferred out of the job he loves after criticism by 5th Circuit Solicitor Dick Harpootlian.

Harpootlian asked a circuit judge last week to void a deal made by Lott a year ago that dismissed charges against a father-and-son drug-dealing team, Fabian and Enrique Valencia, in exchange for information about drug deals in South Carolina.

Harpootlian said the deal, which hasn't resulted in any arrests in this state, never should have been made. Judge Carol Connor is still considering whether she'll void the agreement.

"I think the conduct of Capt. Lott in the Valencia case . . . gave rise to serious questions about his judgment," Harpootlian said. "He let two of the county's biggest drug dealers go free."

Surprisingly, Sheriff Allen Sloan, who had strained relations with Lott last year and threatened to move him to the burglary division, has come to Lott's defense and says the move has nothing to do with the Valencia case.

"That deal was sanctioned by (former 5th Circuit) Solicitor Jim Anders," Sloan said. "Leon thought it was a good idea, and he still thinks it was a good deal. I back the boy 100 percent."

Sloan said Lott has expressed enthusiasm about his new responsibilities as captain of administration and believes that it's time to move on after nine years of heading the narcotics division.

But a somber Lott, who said he had no choice but to accept the new job because he has three children and a wife to support, gave a different account of the move late Thursday night.

Lott said Harpootlian gave Sloan an ultimatum: Get rid of Lott or there would be "major problems" between the Sheriff's Department and the solicitor's office.

Harpootlian denies pressuring Sloan.

"It's unfortunate that Leon views everything in this sinister way," Harpootlian said. "That might be the way it works in the world of narcotics, but this is the world of professionals.

"It's the sheriff's prerogative to organize his office in a way that's going to be most conducive to a good working relationship."

Sloan said Lott will be in charge of training, the DARE program, drug testing of applicants and officers and recruiting and hiring. He also will be in charge of seeking grants.

Deputy Chief Fred Riddle, who, unlike Lott, dresses conservatively in a suit and tie each day, will have the narcotics division added to his responsibilities.

"This will assure a daily account of everything they do," Sloan said. "But I am not in the least bit discouraged or unpleased with Leon's performance."

Riddle, who will be Lott's supervisor, will continue to be in charge of investigations and administration.

Lott also was criticized by Harpootlian and several defense lawyers for failing to monitor his drug agents' deals, spending $18,000 on a Mustang chase car and requiring his officers to meet quotas.

"This constant pressure to meet quotas means quantity takes precedence over quality, which means you arrest someone in whatever way you can," said Leigh Leventis, a Columbia attorney.

"Unless you have assets to turn over or agree to work for them as a snitch, they say you're going to prison. The system has allowed all kinds of abuses," Leventis said.

But Lott denies enforcing a quota, saying the number of arrests varies from month to month. He also said in a recent interview that he keeps close watch on his 26 narcotics agents to make sure they're following the law.

"I control narcotics with an iron fist over my guys. I try to be aware of everything that goes on. They have high intensity to work and perform," Lott said. "We're out there working our butts off to do something about the drug problem."

Lott, who was voted South Carolina Law Enforcement Association officer of the year in 1989, said work has been the focus of his life.

"I love narcotics. I don't know what I would do if I was transferred," Lott said last month.

Troubles in the private college sector

You know about all the budget cuts that have hit USC and other state institutions, but I was just talking to Caroline Whitson, president of Columbia College, and trying to operation a private college is no bed of roses these days, either. She had called me earlier in the day, and I got her back on her cell while she was walking the dog…

Most of the college's funds come from tuition (I had guessed it was from gifts, but I guessed wrong), and that's not exactly the most dependable funding stream at the moment. With so many families hurting, and student loans harder than ever to get, she said she's "not sure what enrollment is going to look like in the fall." So the college is looking at all sorts of contingencies.

As for gifts, well… whether your name is Pastides or Whitson, you tend to hear from a lot of people that their portfolios are down, and this just isn't the best time…

Me, I find it hard to imagine being in that situation, because I've never had a flippin' portfolio.

Real life anecdote follows:
As I was getting off the phone with Caroline, my wife called on my cell to remind me that she'll be home late, so I might want to stop at the grocery on my way home if I want to eat. And I should remember that there is $15 in the checking account until I get paid, so don't go over that. Of course, as I recall she told me the day after I got paid LAST time — after she'd paid the bills — that there was only $11 in the account. I guess the additional $4 is all that's left from her pay after we paid some MORE bills.

You know how they say you should always have two months salary in an accessible account in case you lose your job? That always makes me laugh maniacally, because the only time I ever have two WEEKS pay is for about five seconds after I get paid every two weeks (and of course I never have two weeks gross, just net). And no, I'm not complaining. I know I'm well off. All I have to do is look around me — at work, in the community, among friends and family — to see how well off we are. But how other people build up portfolios, I don't know. Somehow, the world always knows EXACTLY how much is in my paycheck, and all the bills add up to that amount — give or take $15. I don't know how they coordinate it. Actually, I don't think they do. You know what I really think it is?
God doesn't want me to have money — he knows me too well, and doesn't trust me with it or something. I'm not being facetious. I'll explain my theological view on that another time.

Oh, and when they call from our alma mater — Memphis State, which has changed its name — seeking contributions, I do not laugh maniacally, but only because I'm polite.

Midlands leaders band together to take advantage of stimulus

This afternoon we were visited by a rather distinguished and diverse group of business, academic and political leaders who have been putting their heads together to see how our various interlocking existing community ecodevo initiatives — Innovista, the 3 rivers greenway, hydrogen and fuel cell efforts, and so forth — can position our community to take advantage of the stimulus funds once they start flowing to achieve some of our existing goals.

As Lee Bussell said when he asked for the meeting:

With the first mention of the stimulus bill we pulled together a working group of about 25 people representing business leaders, USC, the city, counties, Midlands Tech, Central Midlands, The Chamber, Good to Great Foundation, SCRA, Columbia USC Fuel Cell Collaborative and a number of others .
Our purpose was not just to make sure Columbia participated in the creation of jobs through this special program. We identified that for the last 5 years we have been working toward building a sustainable and green community with the creation of an economy based on alternative energy solutions. Sustainability and green jobs have become a central part of our community development strategy.
I am asking on behalf of all of these groups that you consider pulling together a group at the State that we could come meet with next week. We think it’s critical that you understand what we are attempting to accomplish. It could truly enable our regions to find opportunity to not only create jobs, but also to create an everlasting impact on the sustainability of our community and a whole new economic approach.

Basically these folks represent a lot of different efforts that will be combined and coordinated as the situation warrants to seek funding for things they were going to do anyway, with the goal of long-term economic transformation for the community. As Harris Pastides said, the test of success will be whether, after the construction workers are gone, we still have jobs here that put us on the cutting edge of the nation's move toward a greener economy and greater energy independence.

Toward that end — and with Congress not yet decided toward the final shape of the stimulus — Mayor Bob has set up a War Room in his office at City Hall. Pres. Pastides says he'll be doing the same at USC. The watchwords, says Coble, will be nimbleness, persistence and resources as opportunities are seen to match local projects with stimulus funding streams.

The group was very optimistic that the sorts of things they're working on here in the Midlands are a good match, and at a good point in the pipeline, for matching up with priorities they're seeing in the stimulus, and also with longer-term priorities of the Obama administration.

That's what I recall off the top of my head; I haven't gone back through the recording I made. (Sorry, no video; I took out my camera last night for a family birthday party, and forgot to put it back in my briefcase.) I expect some of the news folks who were there will have something in the paper that will flesh this out a little. I just wanted to go ahead and get my contact report filed…

(And no, in case you're wondering, neither the governor nor any representative of his was there. As Coble said, our governor is seen as an obstacle in this process; whether that obstacle will be surmountable or not remains to be seen, but the folks in the room seemed determined to try…)

The sheriff’s dilemma

Hey, y'all leave my twin Leon alone. The sheriff's got enough problems without folks giving him a hard time for saying he wants to apply the law equally. (And no, y'all haven't been piling on so much here on the blog, but I keep reading the letters and so forth…)

That said, I find myself wondering: Is there a case here to prosecute? I mean, are there precedents that lead one to think this is a case worth pursuing?

The theory in favor of the sheriff going after Michael Phelps goes like this: A rich, white, international celebrity shouldn't skate for doing something that poor, obscure, black kids do time for. That sounds good. Equality before the law and all that.

But I wonder: How many of those poor, obscure, black kids were put away on the basis of the sheriff having heard that they smoked dope at some time in the past, accompanied by a photo that in and of itself is vague. If the alleged perp weren't admitting it, we wouldn't know that was him, or that he was actually smoking dope through that bong. (Before you scoff, I had a good friend in college — a boy from Clio, as it happens — who had shoulder-length hair, and who liked to use Zig-Zags to roll himself a joint made of pure pipe tobacco. If not for the sweet smell, no one would have believed that wasn't dope. But it wasn't. It takes all kinds to make a world, you know.)

If you make me pick a number, I'd say the number of guys doing time at the Alvin Glenn center, or in the state pen, who were put away on that sort of evidence would be approximately zero. Generally speaking, if you're not holding at the time of arrest, the cops don't bother, right? So how is this equality of the law, speaking in terms of way things actually work in the world?

But maybe I'm wrong. Maybe the prisons are full of people who were nailed when somebody posted a picture of them apparently toking on MySpace. I'd be quite interested to hear evidence to that effect.

Columbia’s sin was not knowing

Did you read Adam Beam's story this morning?

    Columbia is expected to have at least a $10 million shortfall in its general fund for the 2008 budget year — the largest for South Carolina’s capital city, preliminary audit figures show.
    Taxpayers will have to cover the deficit from the city’s rainy day fund — which could have been avoided had the city adjusted its employee health insurance plans two years ago to cover rising costs, Deputy Finance Director Bill Ellis said.
    But two years ago, the city’s finance department was in such disarray that city officials did not realize they were spending millions of dollars more than they had budgeted for health care.
    The city spent $18 million over budget from the fiscal years 2005 to 2007. In 2008, which is still being audited, Ellis estimates the city spent more than $8 million over budget for health insurance.

The sin wasn't spending more than projected on health care. Everybody's had that happen year after year, in the private and public sectors. The sin was NOT KNOWING the city was overspending on health care, and not reflecting that in subsequent budgets, or in terms of requiring a contribution from employees. (And note I didn't say an INCREASE in the contribution from employees — Adam also notes that most employees pay nothing for coverage: "Single employees with no dependents — who make up the majority of the city’s work force — don’t pay for their health insurance.")

Add to this the overview Adam did over the weekend of what we know so far of how messed up the city has been under Charles Austin and under this council. And you may then see why we gave Austin a failing grade on his evaluation (our eval, since the council couldn't seem to get one together), and the council a failing grade on supervising him, and called yet again for a system of government that the voters can hold to account.

Letter I: Riley a stumbling block to reform opponents

One point I'd like to make with regard to this letter on today's page, which takes exception with our advocacy of a strong-mayor system for Columbia, most recently articulated in our Sunday editorial:

City’s government should remain as is

I read
The State’s Sunday editorial, “City should change system, not hire
another manager,” with dismay concerning your recommendation that
Columbia change its form of government.

Choosing a strong-mayor
form over the council-manager system could have dangerous consequences
for the city. These involve the likely emergence of a cult of
personality and abuse of power by individual council members.

Early
in the 20th century, the council-manager system was formulated (some
say for the first time in Sumter) to bring professionalism to city
administration and to distance politics from the daily operation of
municipal functions.

Overall, the hiring of professional managers
to carry out council policy has been successful. Even cities as large
as Dallas have city managers. Philadelphia has a strong-mayor form of
government.

Selecting the strong-mayor form would be ill-advised
because a less-than-stellar mayor (after all, how many Joe Rileys are
there in South Carolina?) could make matters much worse.

Columbia
is now seeking a professional manager and then should work to ensure
that he implements goals of efficient and effective government while
letting council set policy.

There is one thing that opponents of strong-mayor always have to confront when they try to dismiss the idea: Joe Riley. They always have to say, "There's only one Joe Riley," or "Joe Rileys don't grow on trees," or "Joe Riley isn't going to move to Columbia."

Why do they have to say that? Because, when they look around for examples to support their point, if they were to say, "Why, look at the only other major city in South Carolina that has a strong mayor," they would immediately have to say, "No, DON'T look at the only other major city in S.C. with a strong mayor," because in that city, the system is a generally acknowledge success. And by generally acknowledged, I mean that Charleston gets all sort of national recognition for being a well-run, well-led city. And while Mr. Riley always has opposition (which you would expect a Democrat to have in a city with so very many Republicans in it), he wins re-election time and again with about three-fourths of the vote.

No, Joe Riley is NOT going to move to Columbia (he decided that for good when he decided not to run for governor in 1998, which was a terrible shame for our state). But let me tell you something just about as certain — if there is another Joe Riley out there, he isn't going to run for mayor of Columbia unless we make the job worth running for. And right now, it isn't.

Yes, folks, I know that council-manager was considered a "reform" when it came along, an alternative to bossism and the like. So was, in its day, the city commission form, which I had the opportunity of studying up close and personal in Jackson, TN, long ago.

But look around you: This system is NOT WORKING, and it has not worked under the last several city managers. The city is a mess, and no one can be held accountable for fixing it. Each member of the council (including the mayor, who has no more say than any other member) can point to the other six and claim, quite truthfully, that he or she lacks the power to do anything without a majority.

So everybody skates when we have the kind of mess we have now, except for the city managers that come and go.

This needs to change. And the first step is putting someone accountable to the voters in charge.

Charles Austin calls it quits

Two days after our editorial "evaluation" of Columbia City Manager Charles Austin — in which we gave him a failing grade — and the same day as our editorial hitting his bosses, the city council, for their part in his failures, Mr. Austin announces that he will retire at the end of March. Here's what our colleagues down in the newsroom have about it:

Columbia City Manager Charles Austin announced his retirement today, effective March 31.

"Over
the past weeks, especially over the holidays, I have had the
opportunity to reflect my plans for the future," Austin said in a
statement. "After many discussions with my family and a great deal of
thought about this stage of life I now am in, I have decided to
announce my plans to retire as city manager on March 31.

"I have enjoyed my years of service with this great city and wish city council and staff my best."
Austin has been publicly criticized for more than a year for his handling of both the police department and city finances.

City
Council members would not comment but released this statement: "Today
the city manager informed us of his intention to retire at the end of
March. We appreciate his many years of service to our city as police
chief and city manager and accept his decision. We stress that it was
his decision with which city council concurred."

Austin took over as interim city manager on March 15, 2003, after City Council fired former city manager Leona Plaugh.

Plaugh
was fired for targeting certain high-ranking employees for demotion or
marginalization. She was sacked after it discovered she created a
four-page document that described employees as "hatchets," "beavers,"
"alligators" and "moats." It also listed them under categories
"destroy" and "conquer."

Plaugh lasted for 18 months.

Her predecessor, Mike Bierman, was manager for four years before walking out in frustration during his evaluation.

Miles Hadley managed the city for eight years before retiring.

And Gray Olive, Columbia's first manager, was in office for 19 years.

Steve Gantt will be the interim city manager.

Our evaluation of Charles Austin

Since Columbia's increasingly indecisive, divided city council is struggling (once again) to come up with an evaluation of City Manager Charles Austin — I believe the council is supposed to try to get back to it today — we thought we'd help by offering our own on today's editorial page:

Columbia’s woes
should earn Austin
a failing grade

COLUMBIA CITY Council is taking its time evaluating city manager Charles Austin, and there’s no telling what conclusion the divided body might reach.
    But as we consider the poor management of two key departments over the past couple of years, the picture is not good.
    Mr. Austin has done good things since being hired in 2003. With city administration in turmoil at the time, he restored a measure of public confidence and boosted employee morale. He took charge, streamlined meetings, removed small items from the council’s plate and attempted, unfortunately unsuccessfully, to stop council from meddling in daily operations.
    We had high hopes that Mr. Austin would draw on his successful 11-year stint as police chief and grow into the job of city manager. That hasn’t happened. He’s faced considerable challenges as the police department fell into disarray and the finance department proved dysfunctional and unaccountable.
    At one point, the once well-respected police department went three years without a chief, a position Mr. Austin appoints. Once a chief, Dean Crisp, was hired, he lasted three years before abruptly retiring. The department’s reputation took a big hit when officers were said to be cheating on an online recertification test. Mr. Crisp disciplined 21 officers by suspending most of them for two to five days, demoting several and putting all on probation. After Mr. Crisp’s retirement, interim Chief Harold Reaves reversed the suspensions. Inexplicably, Mr. Austin, who had signed off on Mr. Crisp’s decision, went along with Mr. Reaves’ reversal.
    In addition, a report last March by a five-member citizens panel said the department lacks adequate manpower and equipment and does a poor job of recruiting, training and retaining officers.
    The city has had worse problems in the finance department, which fell two years behind in closing its books and getting necessary audits. The council had to build budgets without knowing what the city had taken in or spent the previous year. The capital city has had to call on outside consultants and auditors as well as the S.C. Municipal Association for help. One audit showed the city lacked some internal controls to keep track of its money, failed to follow some of its own procedures and didn’t report financial information in a timely and accurate manner.
    Mr. Austin is trying to turn things around. He’s hired a permanent police chief, and the council has approved 14 new officers and a pay and retention plan. He has reconfigured the finance department, hired new staff and begun implementing new procedures. A search is under way for a finance director.
    But each forward step is matched by revelations of general sloppiness punctuated by outrageous blunders. Last week, we learned the city paid some bills at least twice for at least four years, didn’t regularly reconcile bank statements and lost millions due to poor investment decisions.
    Mr. Austin had never been a city manager when he took the position, and this often shows. Meanwhile, the City Council is utterly ineffective in holding him accountable. Unfortunately, the buck stops nowhere in the city’s council-manager form of government, with responsibility divided among the unelected manager, the weak mayor and the six other council members, four of whom represent single-member districts.
    But the fact is the city is in a mess, and it’s Mr. Austin whose evaluation is under discussion. He deserves a failing grade.

If I recall correctly, the last time around — in late 2007 — the council had trouble coming up with a written evaluation, and when it did, it was hand-written on a legal pad. Here's hoping for something a little more professional this time. But we're not holding our breath. Seven bosses with separate agendas can't hold one employee accountable, just as voters have no one to hold accountable, because they merely elect the seven (and of course, no one voter gets to vote for more than a minority of the seven). The structure of city government is made for this kind of confusion.

In praise of good ideas, starting with school district consolidation

You know, I sort of damned the good news about the growing DHEC consensus with unfairly faint praise earlier today. (Or darned it, at the very least.)

I need to start looking more at the bright side. I don't spend enough time looking at things that way these days. We're all so overwhelmed by the economic situation — and if you are in the newspaper business, you are steeped in it (nothing is more sensitive to a slowing economy than an already-troubled industry that is built on advertising revenues). It's very easy to dwell on such facts as this one that has stuck in my head since last week: That not only did the U.S. economy lose 2.5 million jobs in 2008, the worst since 1945, but 524,000 of those jobs lost were in December alone. To do the math for you, if the whole year had been as bad as the last month, the total would have been over 6.29 million. And there's no particular reason to think January won't be worse than December.

I'm not a big Paul Krugman fan, but stats like that make me worry that he was right in his column, which we ran on Sunday, saying that the Barack Obama stimulus plan, overwhelming huge as it is, won't be nearly big enough.

And these are not cheery thoughts. Nor is it cheery to reflect, as I did in my Sunday column, about how resistant policy makers in South Carolina are to policies that make sense — even the more obvious policies, such as increasing the cigarette tax to the national average, or restructuring government to increase accountability, or comprehensive tax reform.

That's what we do in this business. We harp. Year in, year out. We can be tiresome. We can, as I suggested Sunday, get tired of it ourselves. But little victories such as this emerging consensus on DHEC, or the signs that we saw last year that even some of the stauncher opponents of restructuring in the Black Caucus are coming around on the issue (which is a real sea change) are worth celebrating, and encouraging — like putting extra oxygen on an ember.

So it is that I applaud Cindi today for, instead of doing her usual thing of mocking the stupider ideas among the prefiled bills, giving a boost to the better ideas. There were some good ones on her list.

In fact, I was inspired to do a little followup on one of them:

H.3102 by Reps. Ted Pitts and Joan Brady would shut off state funds to
school districts with fewer than 10,000 students, in an attempt to make
inefficient little districts merge.

Now that's the beginning of a good idea. Like most obviously good ideas, it isn't new. We've been pushing for school district consolidation as long as we've been pushing restructuring and comprehensive tax reform, etc., and with even less success. Everybody says they're for it in the abstract; no one lifts a finger to make it happen. Even Mark Sanford gives lip service to it (but won't work to make it happen, preferring to waste his energy on ideological dead-ends such as vouchers).

So it's encouraging that Ted Pitts and Joan Brady (and Bill Wylie and Dan Hamilton) want to at least set a starting place — a numerical threshold, a line that the state can draw and say, "We won't waste precious resources paying to run districts smaller than this."

Mind you, I'm not sure it's the RIGHT threshold. I've always thought that the most logical goal should get us down from the 85 districts we have now to about one per county — which would be 46. The 10,000 student threshold overshoots that goal, as I discovered today. I asked Jim Foster over at the state department of ed to give me a list of the sizes of districts. The latest list that he had handy that had districts ranked was this spreadsheet
(see the "TABLE 1-N" tab), which showed that as of 2006, only 18 districts in the state had more than 10,000 pupils. One of those — Kershaw County — has since risen over the magic mark, so that makes it 19.

Maybe we should have only 19 districts in the state, although I worry that a district that had to aggregate multiple counties to be big enough might be a little unwieldy.

But hey, it's a starting point for discussion on an actual reform that would help us eliminate ACTUAL waste in our education system, and provide more professional direction to some of our most troubled schools (which tend to be in those rural districts that just aren't big enough to BE districts to start with).

So way to go, Ted and Joan (and Bill and Dan).

I was particularly struck that Ted was willing to put forth an idea that would have an impact in his own county (although perhaps not, I suspected, in his actual district). That's the standard reason why district consolidation gets nowhere — lawmakers balk at messing with their home folks districts, because voters tend to be about this the way they are about other things; a reform is great until if affects them.

I suspected, and Jim's spreadsheet confirmed, that while Lexington 1 and District 5 were big enough to retain state funding under this proposal, Lexington 3 and 4 were not. More than that, Lexington 2 falls below the threshold, and at least part of Ted's district is in Lexington 2. (Unless I'm very mistaken. Ted is MY House member, and my children all attended Lexington 2 schools.) As for Joan Brady — I think her district would be unaffected, as Richland 1 and 2 would be untouched (even though they shouldn't be — they should be merged). But I still applaud her involvement.

Anyway, way to get the ball rolling on this, folks. Let's keep talking about this one.

Mayor Bob, master of qualification

Columbia Mayor Bob Coble seems to have set a new standard for caution and qualification in his statement in today's story about the city's long-standing, inexcusable inability to keep its books straight (today, we learned, it has sometimes paid the same bill — including to its external auditor brought in to deal with the mess — two and even three times).

Here's what the mayor said:

"With the new hires and new procedures, hopefully we feel confident that
we are on the way to getting the very best finance department we can."

He couldn't just say, "We've solved the problem," because among other things, Mayor Bob is a truthful man. But let's count the qualifications, counting backwards:

  • "the best finance department we can" — Not the best, just the best we can get.
  • "we are on the way to getting" — He's not gonna claim we're there.
  • "confident" — He doesn't even know that we're on the way; he's just "confident" that we are.
  • "feel" — OK, he doesn't know we're confident, but he feels that we are.
  • "hopefully" — Actually, he's not even sure that we feel that way; he just hopes that we do.

I don't know about you, but I'm impressed. No one can hedge like our Mayor Bob.

Blogger runs for school board

Among the e-mails awaiting me upon my return today was this one:

You know me from my writing and
protesting about the Confederate flag: I write the blog takedowntheflag.  Some of you
also know me as an active volunteer for Barack Obama and for Anton
Gunn.

I’m writing to tell you that I’m
running for the vacant seat on the Richland Two School Board.  There are nine
candidates, and whoever gets the most votes gets elected (no runoff).  The
election is on Tuesday, Jan 20, and in-person absentee voting is
going on now.  One of the major tasks of the school board will be the oversight
of the building of new schools.  The voters passed a $306 million bond
referendum for new schools in November.

In Richland District Two, we need to

  • build new,
    well-designed schools to accommodate the amazing growth in our
    community.
  • provide more technology
    for students and more ways for students to be engaged in both curricular and
    extracurricular activities.
  • develop strategies to
    address No Child Left Behind and Act 388 so that we’re serving all students,
    teachers, parents, and everyone in our community.

I'm a public school teacher, and I
have a PhD in engineering from Northwestern University.  I teach math in Sumter
(we have a carpool); my sister Tracy teaches math in Hilton Head; my sister
Kelly teaches math in Atlanta; and my brother Kevin also teaches math in
Atlanta.  My wife Amy and I have two children. Our son Aidan is 6 years old and
is a first-grader at Polo Road Elementary School (we like the Spanish program
there). Our daughter Kate is 2½, and we plan to enroll her in one of Richland
Two’s child development programs this fall.

What I’m saying is: I'm a public
school teacher and a well-qualified candidate. I've got a huge amount of
interest in the position, and I will do an awesome job.  Please check out the

NYT sees Columbia as microcosm of economic decline

Don't know how I missed the story in yesterday's New York Times about the job fair in Columbia — headlined "Reeling South Carolina City Is a Snapshot of Economic Woes" — but in case you did, too, here it is. And here's an excerpt:

    As the American economy sinks deeper into one of the more punishing recessions since the Depression, frustration and fear color the national conversation.
    This city in the center of South Carolina is an ideal listening post. According to a range of indicators assembled by Moody’s Economy.com — from job growth to change in household worth — this metropolitan area came closer than any other to being a microcosm of the nation over the last decade.
    This is now an unfortunate distinction. Some 533,000 jobs disappeared from the economy in November, the worst month since 1974. In South Carolina, a government panel is predicting that the state’s unemployment rate could reach 14 percent by the middle of next year….

I missed my chance, Jerry!

Last week, I meant to react to this news …

About 20 DHEC and EPA agents raided the city’s sewer plant at 8 a.m.
Thursday, armed with a search warrant, weapons and wearing bulletproof
vests — just as parents were dropping off their children at nearby
Heathwood Hall Episcopal School.

… by saying that if it had been ME raiding that place, I don’t think I’d have worried about bulletproof. Bullets wouldn’t have been my main concern. I’d have gone for a hazmat suit. But that’s me.

But forgetting to say that until now at least gave me the excuse of using that headline about "missing my chance."

Now that we’ve had fun, I’ll raise the serious question: First the police department messes. Then the inability to close out the fiscal year because no one knew how. (Or was it the other way around?) Y’all know I like ol’ Mayor Bob, but one begins to wonder if there’s anything the city knows how to do right. I guess I’ll just use it as another excuse to push for the strong-mayor system that would at least give Columbia voters someone to hold accountable.

Free Chicken

On my way to work today, I found myself trapped behind a chicken truck on Sunset Blvd. (the one in West Cola, not the one in L.A.), from I-26 all the way to Columbia Farms.

First, for those of you who haven’t had this experience, banish from your mind any bucolic image of "chicken truck" as the Clampett mobile with several chickens perched up on Granny’s rocker. This is a tractor-trailer in which the full three dimensions of the trailer are taken up with individual cages — sort of a poultry skyscraper on wheels — with uniformly white and miserable-looking chickens on their way to their doom, with billows of white feathers and a foul stenching streaming off the entire load.

The rig was well ahead of me, but not so far that I wouldn’t end up inhaling its miasma at a traffic light if I didn’t either pull over and let it go well ahead, or pass it. The preferred method would be passing it, but since it was apparently doing more than 50 in a 40 zone and seemingly accelerating in that downhill stretch past Hummingbird, that didn’t seem doable without both a) speeding and b) getting closer to it with no guarantee of getting past it. So I hung back — and ended up directly behind it at the stop light at 12th St. Of course,  I closed my vents.

And it was at that moment that I realized what I had been listening to on FM 102.3 since I had first come upon the truck. Yes, ladies and gentlement, it was Lynyrd Skynyrd’s anthem "Free Bird." Near as I can tell, though, none of the chickens were holding up their cigarette lighters as the song approached its climax.

The folks in charge of the soundtrack of my life have an affinity for irony, you see.

During the final instrumental portion, I turned off onto 9th St. So I wasn’t there for the chickens’ big finale.

What’s with this Esplanade, and why am I not getting my taste?

Have you noticed, in that blink of an eye just before you cross the bridge heading toward West Columbia from downtown, a sign that says "Esplanade?"

All I can tell is that it seems to have something to do with the CanalSide development — or the riverfront, in any case. Looking back, I see passing references to it in the paper, and this notice to contractors.

Which makes me think somebody’s pulling a fast one on me. Given that Columbia can employ 42 people in a "unique" department with the express purpose of attracting Homeland Security dollars, I gotta figure there’s money to be made here, too.

True, I haven’t done any actual work to bring this thing about. But neither did Tony Soprano, and he managed to get a couple of "no-shows" and several "no-works" worth of income from HIS Esplanade.

So where’s my taste?

(Seriously, the development of our riverfront is an exciting and positive thing for the Midlands. I just couldn’t avoid poking a little fun at the "Esplanade" name…)

So do I LOOK like a sap, or what?

That was a rhetorical question. (Imagine Billy Bob Thornton saying that, as Mr. Woodcock.)

Jeffrey Sewell from over at S.C. Hotline sent me this suggestion:

Would you consider a blog piece encouraging folks not to give
to panhandlers but directly to shelters and churches during the holiday season?

Would that work? Even for a notorious soft touch like me? Long ago, back when I was in college, I sort of developed this attitude that if someone had degraded himself in his own eyes to the point that he’ll beg me as a stranger for money, why not just give him some? I mean, he might as well have the money, because what else has he got?

Admittedly, that’s a poorly defined philosophy, and an odd mixture of sympathy and judgmentalism on my part, but in all the years since, I haven’t really improved on it. I’ve experimented with giving the money, refusing to give the money, and ignoring the supplicant. All three make me feel bad — the first because I’m generally all but certain that I’m being conned (although there’s always the chance that the NEXT guy who needs just a little more money so he can catch the bus to Greenville to see his sick child will be telling the truth), and the others because, even if it’s a con, they make me feel like a rat.

So generally speaking, I’m a soft touch for beggars. But what gets me is that they can spot me at a distance. Either there’s a panhandler database on the Internet with my name and photo on it (so that’s what they’re all doing when they hang out at the library), or they can just TELL. The way I can just tell they’re going to hit me up from the first clearing of the throat, or the first move in my direction.

Sometimes, I can tell before that. Over the weekend, I was parallel-parked in 5 Points. I was in my vehicle already and just about to start the truck and pull away when I saw, about 10 feet off my starboard bow, a panhandler approaching a young woman. I said to myself, "Go, go, GO!" and cranked the ignition, but even though there was every reason to think I’d escape, somehow I knew that the young woman wasn’t going to buy me enough time; he was going to bypass everyone else and somehow get to me before I could get away. And he did. I started the truck, looked over my shoulder for a break in the traffic, and there he was, tapping on my closed window and holding up — this is the best part — an actual, official, U.S. military ID card.

I rolled the window down (what am I gonna do; run over a veteran to get away?), and he was already into his spiel, of which I only caught bits … "Green Beret… nineteen sixty-four…" Yes, it was the classic Billy Ray Valentine approach:

Uh… I was with the Green Berets – special unit battalion commando airborne tactic specialist tactics unit battalion. Yeah!

Apparently, this was Agent Orange himself. I hastily dug a couple of bucks out of my wallet and handed them over, which provoked a gap-toothed grin. He asked, "Bet you didn’t mumble-mumble-mumble THIS year!" So I said "What?" and he said "Bet you didn’t mumble-mumble-mumble THIS year!" and I said either "Yeah," or "No, I didn’t" noncommitally (how could I have committed? I didn’t know what he was saying). And he grinned and nodded, and I drove off.

Where were we? Oh, yeah, Jeffrey’s suggestion. Good idea. But would that work?

Biggest disappointment of the night: Mike Montgomery’s loss

Looking at both our endorsements AND my predictions I made yesterday, you might have already figured out that my biggest disappointment in last night’s results was Mike Montgomery’s apparent loss of his seat on Richland County Council.

Actually, last night was a bad one all around for you folks who live in Richland County, whether you know it yet or not. In the only other contested race, Gwen Kennedy — remembered mainly for her Hawaiian junket at taxpayer expense (and for almost nothing else because she basically accomplished nothing in office that I can recall) when she was on the Council before — won. But we expected that — there was no way a Republican was going to win that seat against a Democrat with name recognition, even BAD name recognition.

But Montgomery was arguably the best, brightest, hardest-working member of council, a guy who truly had the interest of everyone in the county, regardless of party or anything else like that, at heart. On a council that had lost its way recently — putting $30 million for parks ahead of transportation and other critical needs — he was one guy who was right on those and other issues, an extremely level-headed pragmatist with his priorities straight. This is a deep loss for anyone who cares about the future of the county.

And he lost to a guy who — and I kid you not — had exactly two reasons for running:

  1. He didn’t think Decker Boulevard was getting redeveloped quickly enough.
  2. He thought there should be a Democrat on the ticket to take advantage of the Obama Effect. Really. That was his reason. When his wife, who lost to Montgomery in the last election, wouldn’t run again, he put his own name on the ballot. That’s pretty much his story.

So basically, we have here a monument to party line voting over merit, the most stark that I saw in this election. And it’s a real shame.

Oh, and I would have given you some pictures of these two guys on this post, BUT MY LAPTOP GOT STOLEN LAST NIGHT. But perhaps I already mentioned that.
