… but no pledges, please, Vincent

Having praised Vincent Sheheen for challenging Nikki Haley to actually be transparent for a change (since that’s, you know, her platform), I’ve gotta say I’m with Nikki on this:

Democratic gubernatorial candidate Vincent Sheheen has signed a pledge, promising to make an effort to appoint qualified women to senior level positions on state boards and commissions if he is elected.

Republican gubernatorial candidate Nikki Haley declined to sign the pledge.

Like Nikki, I wouldn’t sign the pledge, either.

Now settle down, ladies. (If you’re OK with me calling you ladies.) Nothing against hiring women.

The problem is the pledge.

My objection may seem a bit wonkish and technical, but please attend:

I believe candidates should not sign pledges about what they will do or not do in office. The cause doesn’t matter; the problem is the pledge itself. It undermines the integrity of the political process. Candidates may speak of general intentions, but specific promises — particularly when taken to the extreme of putting them in writing — are a bad idea.

It is essential to self-government, and particularly to our system of representative democracy, that once in office a public servant should study the actual situation that he faces in office (which can never be accurately, fully anticipated before the election), and engage as an honest, unencumbered agent in deliberation with others to reach a decision about what to do.

You think this is just a fine point, a mere ephemeral abstraction? Well, you liberals applauding Vincent for this stand should take a moment and contemplate the severe damage done to South Carolina by the fact that Grover Norquist got so many GOP lawmakers to sign his anti-tax pledge. It has made comprehensive tax reform impossible, and led to a downward ratcheting of tax revenues that had nothing to do with the state’s actual spending needs, and everything to do with Norquist’s aim of shrinking government to the point that he can drown it in a bathtub.

But whether you like the aim of the pledge or not, they are a bad idea — that includes the pledge that Democrats were passing around awhile back to promise to spend more on education — because they shackle an officeholder from dealing in the future with the actual, practical situation that lies before him.

So Vincent — please do express your desire to see more qualified women serve in your administration. That’s great. But no pledges, please.

But first, Graham gets cheap shot from the left

Today everybody and his brother in the national media is writing about how Lindsey Graham can expect attacks from the right wing of his own party for voting to confirm Elena Kagan.

But they reckoned without him getting hit by a cheap shot from the left — from the S.C. Democratic Party, specifically:

COLUMBIA-Today South Carolina Senators Lindsey Graham and Jim DeMint held tight to their Republican Party principles by voting against legislation to restore unemployment benefits to workers who have been out of work for more than six months. Despite the senators’ efforts to continue a Republican filibuster of the bill, the measure passed 60-40.

South Carolina Democratic Party Chair Carol Fowler called Graham and DeMint’s votes shortsighted and wrong.

“It’s shameful that Senator Lindsey Graham and Jim DeMint would ignore the needs of thousands of hardworking South Carolina families for the sake of partisanship. We can’t afford to play politics in a state where the unemployment rate continues to be well above the national average. Our senators should have stood with their fellow Republicans Olympia Snowe and Susan Collins and done the right thing for South Carolina,” said Fowler.

Really. Not a word about his courage in voting for Kagan — nothing about the actual news that he made today. No, the Democratic Party — being a political party, and therefore incapable of mastering anything more complex than “him Republican; them all alike” — attacks him with the slur of saying he’s no less a knee-jerk ideologue than Jim DeMint.

And that’s outrageous.

Graham’s vote for Kagan, in his own words

To follow up on the previous, here’s how Lindsey Graham explained his vote for Elena Kagan for the court.

I have defended, and will defend, our senior senator for his thoughtfulness, while at the same time being mortified that it is necessary to defend someone for acting with intellectual honesty and not acting like a partisan automaton. What has our country come to that this sort of thought-based action has to be defended? What happened to us that such principle has become so rare?

In any case, he defends himself better than I could.

I like in particular that he gave a Federalist explanation for his decision. It harks back to a time when intelligence and principle were not rare at all in this country:

Graham Supports Kagan Nomination

WASHINGTON – Citing the Constitutional and historical role the Senate has played in Supreme Court nominations, U.S. Senator Lindsey Graham (R-South Carolina) today said he would support the nomination of Elena Kagan.

“No one, outside of maybe John McCain, spent more time trying to beat President Obama than I did,” said Graham.  “But we lost and President Obama won.”

Graham cited Alexander Hamilton’s Federalist Number 76 in listing the reasons he would vote for Kagan.  Graham noted Hamilton wrote, “To what purpose then require the cooperation of the Senate?  I answer that the necessity of their concurrence would have a powerful, though in general a silent operation.  It would be an excellent check upon a spirit of favoritism in the president, would tend generally to prevent the appointment of unfit characters from family connection, from personal attachment, and from a view to popularity.”

“The Constitution puts a requirement on me, as a senator, to not replace my judgment for the President’s,” said Graham.  “I’m not supposed to think of the 100 reasons I would pick somebody different.  It puts upon me a standard that stood the test of time: Is the person qualified?  Is it a person of good character?  Are they someone that understands the difference between being a judge and a politician?  And, quite frankly, I think she’s passed all those tests.”

“Are we taking the language of the Constitution that stood the test of time and putting a political standard in the place of a constitutional standard?” asked Graham.  “Objectively speaking, things are changing, and they’re unnerving to me.  The court is the most fragile of the three branches.  So while it is our responsibility to challenge and scrutinize the court, it is also our obligation to honor elections, respect elections, and protect the court.”

“I view my role as a United States Senator in part by protecting the independence of the judiciary, and by making sure that hard-fought elections have meaning in terms of their results within our Constitution,” said Graham.  “At the end of the day, Ms. Kagan is not someone I would have chosen, but I think she will serve honorably.”

Sanford Redux? Let’s pray not. But the long knives ARE likely to come out for Lindsey

First, the good news: As the one most thoughtful and principled Republican in the United States Senate — a guy who will fairly consider Democratic court nominees, just as he demands the same intellectual honesty from Democrats with Republican nominees — Lindsey Graham today became the only GOP senator to vote Elena Kagan out of committee.

Sure, some of the Republicans who voted against her and Democrats were voting for were voting their convictions, too, but the only person you KNOW was doing so was Lindsey Graham, because there was nothing in it for him politically. Except for the respect of us UnPartisans, and we’re not that powerful a lobby.

So, for the sin of being thoughtful and intellectually honest and really meaning it when he says elections have consequences and presidents’ choices, if qualified, should be given respect by the opposition, back home the yahoos are lining up to run against Lindsey Graham in the 2014 primary.

Really. Because this is South Carolina, where we don’t wait around for crazy; we grab it by the throat and ride it to death.

And of course the national media, from the MSM to Jon Stewart, have come to expect crazy from us, and have even started trying to anticipate it.

Which is why today, on the very day of the Kagan vote, we already have The Washington Post’s Chris Cilizza speculating about which Republicans will line up to run against Lindsay.

Frankly, I think it’s an overreaction. I suspect that when all is said and done and four years have passed Lindsey will — if he still wants the seat — face only marginal opposition from within his own party. But given what the nation has seen from the GOP within SC in recent months, who can blame Cilizza for compiling this list?

* Katon Dawson: The former chairman of the state Republican party would have the financial network and connections in the state to make a serious run at Graham. And, he may be looking for a next act after losing out on the Republican National Committee chairmanship in 2009.

* Jeff Duncan: Duncan, a state representative, is the odds-on favorite to replace Rep. Gresham Barrett in the 3rd district this fall. (Graham held that same Upstate seat before being elected to the Senate in 2002.) That would provide a real geographic base from which to run in four years time.

* Mark Sanford: Yes, that Mark Sanford. The soon-to-be-former governor has made clear to political insiders that he is interested in a return to politics and targeting Graham in 2014 might give Sanford enough time to rehab his badly damaged image.

* Trey Gowdy: Gowdy is a heavy favorite to come to Congress this fall after he crushed Rep. Bob Inglis (R) in a primary in the strongly Republican 4th district. He gets rave reviews from smart political people in the state but it remains unclear whether the Senate is an office he covets.

* Mick Mulvaney: Mulvaney, a state senator, is currently running against Rep. John Spratt (D) in the 5th district. Win — or even lose — and he’s likely to be in the Graham primary mix.

* Tom Davis: Davis is a state Senator from Beaufort (in the Lowcountry). He’s also a close ally of GOP gubernatorial nominee Nikki Haley. If Haley is elected governor this fall, her allies will be in the catbird’s seat for offices down the line.

“Yes, THAT Mark Sanford.” Just sends chills down the spine, doesn’t it? It that man’s political career is not over, then there is no justice in the political world. And between the kind of insanity that has some Republicans who would actually vote for him again (and you know there are a lot of them), and enough people on the Democratic side who would and did vote for Alvin Greene, it would pretty much end my faith in democracy as a positive force in South Carolina.

But you know what’s really awful about this? With Lindsey Graham, South Carolina has the best representation in the U.S. Senate that it’s had in my lifetime. Representation that, for once, we can truly be proud of. And the very idea that anyone would want to take that away from us is appalling.

But that they would be motivated to do so by his acting like a rational human being is what really provokes despair.

Here’s hoping that when all is said and done, this kind of doomsday thinking about SC is wrong. But recent history is not reassuring.

Nikki “means business” — but business backs Vincent

Wow. After having won the nomination on a wave of Tea Party extremism, the Nikki Haley campaign is trying rather desperately — and transparently — to portray her as “conservative” in the actual, traditional, conservative sense of the word.

So it is that I got this release from Nikki a few minutes ago:

I wanted to write you a quick note about National Review’s latest article on Nikki’s incredible primary victory and message of conservative reform focused on creating a pro-business, accountable government that’s truly working for the people of this state. Take a moment to read a few excerpts below…

National Review: She Means Business

South Carolina gubernatorial candidate Nikki Haley is a chamber of  commerce conservative…

And so forth and so on…

Hmmm. Nikki “is a chamber of commerce conservative”? Really?

No, not really. Because the SC Chamber of Commerce is backing Vincent Sheheen.

Perhaps the National Review meant that she was “Chamber of Commerce-ish,” or “Chamber of Commerce-like,” or “Chamber of Commercesque.”

But you know what? Not even that would wash. Here’s what Nikki’s campaign had to say about the actual, real-world Chamber of Commerce in reaction to its endorsement of Vincent:

COLUMBIA, S.C. — South Carolina business leaders are sticking with a decision not to endorse state GOP gubernatorial nominee Rep. Nikki Haley as her campaign Wednesday called the South Carolina Chamber of Commerce “a big fan of bailouts and corporate welfare.”

In case you don’t keep up with these things, that’s not the way “a chamber of commerce conservative” talks. That’s the way you talk when you’re the darling of the anti-establishment Tea Party.

Show us transparency, Nikki: Release the e-mails

Did you see the strong editorial in The State Sunday, challenging Nikki “Transparency” Haley for hiding behind a loophole in FOI specifically carved out to protect legislators, and legislators alone, from transparency in order to keep her state-issued e-mail secret?

I was very glad to see it. As the edit pointed out, this isn’t about Will Folks or disgusting sex allegations. Neither The State‘s editorial board nor I expect to find anything about that if we ever see those e-mails. But the fact that this started with such accusations creates a smoke screen that lets Nikki get away with a flagrant flouting of the principles she lets on to hold most dear. From the heart of the editorial:

Ms. Haley, after all, is not just someone who thinks government transparency is a nice thing. Her one claim to fame as a legislator is her crusade to bring sunlight to a legislative process that for too long has protected lawmakers from accountability rather than giving the voters information they deserve. Her entire campaign for governor is built on that push for openness, for letting the public in on the Legislature’s secrets, for eliminating the special perks and privileges legislators give themselves and their friends.

Does that apply only to the direct expenditure of public money?

Does it apply only to other people?

Imagine if the blogger had claimed that he helped Rep. Haley secretly funnel millions of tax dollars into a green-bean museum and steer tens of millions more in cushy no-bid contracts to her campaign donors, and that messages on her government e-mail account would back up his claim. Is there anyone who would not be demanding that she make the correspondence public?

What is she hiding? Why doesn’t she want us to see the messages she has been sending as she juggled her campaign for governor with doing her job as a legislator?

It is not Ms. Haley’s job to disprove unsubstantiated allegations. It is, however, her job to prove that her commitment to ushering in government transparency and ushering out special legislative privileges is sincere — even more since it has been called into question before. She still hasn’t explained what she did to earn more than $40,000 in consulting fees from a government contractor that hired her for her “good contacts.”

If Ms. Haley were governor, we already would have seen her e-mails, because what governors write on their government e-mail accounts is public record. In fact, Gov. Mark Sanford’s attorney saw fit to turn over some e-mails from his personal account, because she determined that he was using it to discuss public business.

If Ms. Haley were the president of the University of South Carolina, we already would have seen her e-mails. Ditto if she were a $30,000-a-year clerk in the bowels of the bureaucracy, because what nearly all state employees write on their government e-mail accounts is public record.

The only reason her public e-mail correspondence has remained hidden is that she is a legislator, and legislators have written themselves a special exemption to the Freedom of Information Act.

This exemption is the very epitome of the secrecy that Ms. Haley vows to eliminate.

I’m glad to see this now. Because at some point, someone was going to point out this obvious inconsistency and raise a stink about it. My concern has been that it would happen in late October, thereby engendering another tidal wave of protective emotion that would sweep Rep. Haley to victory.

The time to address this is now, when there’s time to be calm. Time to see that she cannot possibly have any legitimate excuse not to share these state-sponsored communications.

What is she hiding, indeed? For all I know, absolutely nothing. But then I don’t know, because she’s hiding it, in a stunning display of contempt for the ideals she says she stands for.

Free Times list: “Cabal That Controls Columbia”

I’m way busy on deadline for an ADCO project, but in the meantime I thought I’d give y’all something to chew on: The Free Times’ list of “The Secret Cabal That Controls Columbia: The Power Elite in the Capital City.”

First, that publication’s own disclaimer, which takes a bit of the oomph out of the pitch: “OK, first things first: We don’t really think the people on the list that follows constitute a cabal — we just needed a zippy title to get your attention.”

That said, on to the list:

Well, they certainly got that last one right — my good friend Jack, the Godfather of Five Points. In fact, I really feel like a connected guy reading that list, as I know all but one person on it, and most of them pretty well. With those kinds of connections, I ought to be a mover and shaker myself.

But there are some flaws here. First, not only isn’t this not a “cabal,” but in truth no one “controls” Columbia. And there seem to be omissions from the list. There’s James Smith, but not the other Hardy Boy, Joel Lourie. There’s Eric Hyman, but not Harris Pastides.

But go to the piece, read the explanations, and judge for yourself. And speak out — who is on the list who shouldn’t be, and who isn’t who should?

The Midlands Aviation Summit today

Went to the Midlands Aviation Summit today at the convention center, which was the community’s chance to hear airport consultant Michael Boyd of Boyd Group International (above) assessing the state of, and future prospects for, Columbia Metropolitan Airport.

As you can see below, there was a pretty decent turnout of concerned folks. They ran the gamut from professional ecodevo types from the Chamber, the Midlands Alliance and Midlands Authority for Conventions, Sports & Tourism to business travelers with a beef about the cost of parking at CAE.

Some main points from what he said:

  • That scraping sound is not an iceberg.” The fact that Southwest chose Charleston and Greenville and not Columbia is not a huge deal. Southwest is what it is, and he doesn’t see it as the cure for Columbia’s ills. It’s not “the giant sucking sound.”
  • While we might have challenges with fares and losing passengers to Charlotte, for business purposes CAE provides what Columbia needs — connections to where business travelers need to be.
  • Main thing travel into and out of Columbia needs to be is reliable, to not have our flights be among those that get canceled when there’s a rainstorm.
  • Airlines don’t care about our civic enthusiasm. They don’t want to view cute or pleading videos. Don’t send them the mayor. What they care about is whether they’re going to make any money, because nobody’s taking risks these days.
  • No, don’t start your own airline. Air South? “We don’t talk about that in polite society.”
  • What can civic-minded folks who want to see the airport grow as a boost to the local economy DO? Check out the local airport first. Don’t assume it can’t meet your needs. Give it a chance.
  • We just don’t have enough traffic — enough passengers on big enough airplanes — to bring down fares. When someone pointed out that smaller airports such as Florence and Augusta have lower fares, he said he had no idea why. “I used to be in airline pricing, so I have no understanding of it whatsoever.”
  • The cost of parking is not a problem.

On that last one I had to challenge him. When he said “Nobody cares about the cost of parking,” several people around me muttered, “I care.” I told him that, and also told him that I hear all the time from people who have run the numbers, and come out ahead paying for the gas to drive to Charlotte and park there. I added that even if it didn’t make sense, even if it were totally irrational, it would still be a real problem we had to deal with. Airport Executive Director Dan Mann told me afterward that he gets it. Perception is reality.

(It occurs to me that next time local governments want to invest money in boosting air travel, rather than starting an airline, maybe they could help the airport lower those parking costs. I realize it’s based on the need to pay for the capital investment, but maybe there’s some way to restructure the debt. Or something.)

On the lower pricing in Augusta and Florence… I was glad someone brought that up, and somewhat disappointed he couldn’t tell us why that was the case. But it occurs to me that there must be some reason, his joke about the illogical nature of pricing aside. And if we could find out that reason, and apply it here, it would help.

Based on what Mr. Boyd said and a brief conversation with Dan Mann after the presentation, the thinking seems to be that Columbia’s best chance for expansion of air service lies with Delta, not USAirways. So our local economic developers in the air transportation field are likely to be looking more to Atlanta, less to Charlotte.

Man up, lawmakers: Override those vetoes

Little left to say, except it’s time for lawmakers of both parties in the House to set aside all the B.S., lay down their insecurities, eschew their customary fecklessness, man up and veto those indefensible vetoes. I’m talking about this veto and this one and this one and most of the others.

I’ve really had it with the argument from the GOP leadership that they just have to sustain most of these vetoes. Kenny denied it the other night when I asked whether Nikki Haley’s strong showing last week had scared the leadership into thinking they have to go along with the Sanford nihilists, even though they’ve slapped him down every other time (even when he had a case, which he doesn’t this time). But I’m convinced that’s the only logical reason to explain this fear to do the right thing. Cindi thinks so, too. And Cindi knows WAY more about the budget process than I do. You’ll note that she gives the governor credit where he deserves it, on fairly marginal issues that don’t involve much money (Cindi has always been much more inclined than I am to reach WAY out to try to find some things to give the governor credit on), but she concludes with this cold bath of common sense:

Most insidious is his repeated implication that by vetoing what he considers frills, he will cause the money to be spent on “core services” of government. Now, I’ll be the first to agree that, as he puts it, “the vast majority of this year’s budget should be directed to core government functions like public safety, education, and health care.” But the facts are that 1) that already is happening and 2) his vetoes do not redirect money from “frills” to “core services”; they simply allow the money to sit in the bank for a year.

I have long believed that the Legislature needs to either increase taxes or else eliminate some programs or agencies altogether (and probably eliminate some even if it does raise taxes). But that’s a decision that needs to be made in an orderly way, by a clear majority in the Legislature — not by a disgraced lame-duck governor with an ax to grind and a third of the members of the House. And perhaps not even by a Legislature that is too frightened of its own shadow to make rational decisions about the responsibilities that come with insisting on operating the government. If lawmakers can’t override most of the governor’s vetoes this week, perhaps they should make arrangements to come back to town later this summer, when emotions have settled down, to consider taking some of the money Mr. Sanford wants to squirrel away and using it to patch critical holes that he has created.

And as for you Democrats: I was much reassured by James Smith telling me yesterday that the Dems would override (with the caveat that while that was the leadership position, Dems don’t do bloc voting), but then I read the paraphrase of Joe Neal in the paper this morning saying Democrats have not decided how they will handle Sanford’s vetoes today and I wonder: Will they stick it out and do the right thing? (And you know what? This is one case in which we actually NEED the Dems to vote as a bloc, because that might embolden the jittery mainstream Republicans.)

If they don’t, and if the Republicans (minus the Sanford loyalists) don’t, then on the whole they are useless.

Rep. Smith: Democrats WILL vote to override all 107 Sanford vetoes

Not as a bloc, mind you, because as you know, Democrats don’t do blocs. But according to Rep. James Smith, who called me a few minutes ago to set me straight (thereby saving me a call to him or Minority Leader Harry Ott), it will be the official House Democratic leadership position that ALL of Gov. Sanford’s 107 vetoes should be overridden. And he hopes they will be — but of course that will depend on the Republicans doing their duty by South Carolina — which James suggests the Tea Party has made GOP lawmakers scared to do.

James called me because a lot of y’all were calling him, egged on to do so by this blog (in the absence of really helpful coverage of the

Rep. James Smith

budget vetoes by the MSM). I urge y’all to keep on calling your lawmakers, Democrats and especially Republicans (since there’s more of them) to tell them what you think. And if you’ve forgotten who your lawmakers are, or how to contact them, here are instructions on enabling yourself.

If you’ll recall, House Majority Leader Kenny Bingham told me over the weekend (“Lawmakers will uphold most of Sanford’s vetoes“), the governor is likely to prevail on most of his vetoes of funding for such things as public libraries, the State Museum, technical colleges, SC ETV, the Arts Commission and the Confederate Relic Room and Military Museum in part because Democrats can’t be relied upon to vote to override. He based this on the lack of support he got from Democrats on some key votes on the budget.

James says that was then, this is now.

Indeed Democrats were divided on some things such as court fees. But that has nothing to do with these budget vetoes. If the Legislature fails to override, says the former Minority Leader, it won’t be because of lack of Democratic votes. And of the governor’s 107 vetoes, “I have yet to find one that we would not override.”

And while Kenny is worried, James still hopes “to be successful in overriding them.”

If the Democrats can indeed stick together tomorrow, that means the fate of these vetoes will lie in the bitter rivalry between regular mainstream Republicans and the Sanford fringe — a fringe that was emboldened by Nikki Haley’s near victory in the primary last Tuesday. All Sanford and Haley and their allies need is to drum up a third of either the House or the Senate for Mark Sanford to have his biggest victory in his eight sorry years in office.

Some background on Sanford’s tech system vetoes

You may have seen a piece in The State today by Otie Rawl regarding governor’s vetoes of funding for the S.C. Technical College system. (This may be the only place you’ve seen mention of this in the MSM).

Let me give you some numbers to add to your perspective on this particular outrage of the governor’s.

Basically, the governor was looking for $4 million. What he wanted to do initially was ReadySC. As Sonny White, Midlands Tech president, ‘splained to me this afternoon, ReadySC is the entity at the heart of South Carolina’s ability to tell industrial prospects — the example he gave was Boeing — that yes, we’ll be able to train your workforce for you. As Sonny explained to me, the problem is that the governor simply doesn’t believe that the technical colleges should be involved in economic development. Let me say that again: Our governor (Nikki Haley’s guiding light) does not believe that the technical college system — which was created under Gov. Fritz Hollings as an economic development tool — should be involved in economic development.

The good news is that Sanford was talked out of this, by ecodevo types like Otie Rawl, according to Dr. White.

But the governor still wanted his $4 million. Fine. So he took it out of administration for the 16 technical colleges. He said that the three biggest colleges — Midlands Tech being one — should provide administrative services for the other 13.

Fine, says Sonny. But there’s no plan to do that, no authorizing legislation, no nothing — except the governor’s airy wish that it come into being.

It took me all afternoon, but I finally balanced my checkbook. Having done that, it is with a great sense of self-sacrifice that I know turn back to the state budget. Oh, my head!

Anyway, you’ll recall that I mentioned the e-mail exchange that a reader had had with House Majority Leader Kenny Bingham, which to me raised questions. That reader later wrote to me again to relate a phone conversation that he’d had subsequently with Kenny. That caused me to send Kenny an e-mail asking him the following:

Kenny, I’ve got a question for my blog… is this correct? Did the governor threaten to veto the whole budget again? And did y’all promise to uphold his vetoes if he didn’t?
If so, why in the world didn’t you just tell him to veto the whole budget if that’s what he wanted to do, and then override him, just as you did before?
I’m just not following this…

Kenny responded last night by calling me at home and taking a long time to explain to me what had happened. The two startling things I learned are reflected above in my headline and subhead, to repeat:

  • In all the wrestling back and forth over the budget at the end of the session, at one critical moment the governor threatened again to do the outrageous thing he did in 2006 — veto the entire budget. Rather than call that bluff, the GOP leadership (the group led in the House by Speaker Bobby Harrell, Ways & Means chair Dan Cooper and Kenny) made a deal to uphold most of his line-item vetoes. Why did they not just let him veto the whole budget and override him as they did in 2006? Because between the Democrats, who were voting as a bloc against every move the GOP leaders made, and the Republicans who could be counted on to vote with Sanford, the leaders didn’t think they COULD override a veto of the entire budget. And the leadership didn’t want to see the government shut down.
  • To avoid that, the leadership agreed to sustain most of the governor’s vetoes. I can’t give you numbers, because frankly I’m not sure of them, and Kenny wasn’t giving me precise numbers anyway. We’re talking about roughly $70 million in vetoes that will be sustained. That’s nowhere near the $414 million that the 107 vetoes total up to. But about half of that is a special pot of money created to deal with a special, stimulus-related, higher Medicaid match that Congress hasn’t yet extended, and the governor says they won’t and lawmakers think it will, and even if it doesn’t there’s enough money to last in the program through next February or April, and… well, it gets REALLY complicated. That disputed Medicaid match is isolated in a section of the budget called Part Four. Most of the vetoes lawmakers will be sweating over are in Part One. (Part Two is where you find provisos, and I never even bothered asking about Part Three, if there is a Part Three…)

And yes, the parts they’re likely to sustain include some of the things that folks are most upset about being cut, such as the State Museum. So does that mean the Confederate Relic Room and Military Museum, for instance, will shut down?

going. But there he is relying on the governor SAYING those reserves are available to bail out those programs. And the e-mail campaign against these vetoes that I’ve seen says the governor is wrong about that. I asked, how do you know the governor’s right? And he doesn’t know. I asked, what does Frank Fusco (head of the B&C Board) say? Kenny said he hadn’t talked to Frank yet. Presumably he will before the voting on Tuesday.

Bottom line, Kenny doesn’t know exactly what will happen Tuesday on all those vetoes, because there are a number of things that haven’t been worked out yet. And THAT’S what’s different about this situation. In the past, at this point he would have said with confidence that no one should worry; the vetoes would be overridden. That’s what we’ve seen year after year: Sanford makes his symbolic gesture, and the Legislature keeps the government running.

But this is the first time I’ve seen the GOP leadership this flummoxed over the Sanford vetoes. And as Kenny tells it a lot of it arises from the fact that the leaders just don’t think they have the votes. They blame the Democrats (no surprise there, huh?) for voting against them on a number of key budget votes. He said every single Democrat, with the occasional exception of Herb Kirsh, voted against them. Add to that the minority bloc of Republicans that can be relied upon to vote the Sanford way, and the leadership barely had the votes to pass a budget at all, much less come up with the two-thirds to override the governor.

As an example of the things they fought over… the leadership came up with a plan to raise court fees and license fees to help keep the courts running and pay for the next class of state troopers. The Sanford loyalists wouldn’t go for it, and the Democrats said Republicans should raise a general tax rather than paying for the added expenses with new fees.

I need to talk with somebody with the Democratic leadership this week to get their side of it, but Kenny’s account of the Democratic position sounds pretty credible: Basically, they’re saying that the Republicans got themselves into this mess with their tax cuts and such, and the Democrats aren’t inclined to help them out of it.

Anyway, what I got out of all this was this time, we might actually see some of the more headline grabbing consequences of the governor’s vetoes actually happen: shutting down the State Museum and the Arts Commission, for instance. Might not happen, but there’s a bigger probability this time than ever.

And in spite what I’ve been hearing about how the governor has tried to be more reasonable in dealing with lawmakers since his personal troubles began, it appears that he’s up to his old shenanigans, engaging in the same kind of ideological brinksmanship that we saw at the height of his arrogance.

It’s going to be very interesting to see what happens Tuesday. And those who care about the State Museum or ETV or the arts in SC have every reason to be in suspense.

An exchange about the budget vetoes

A reader writes to me via e-mail to say, with regard to the governor’s budget vetoes:

After receiving an e-mail alert from ETV yesterday and reading about Medicaid cuts, I e-mailed Majority Leader Bingham and asked him to vote to override these two items.  I am attaching his response.  He does not commit to a yes or no answer, and the remainder of his response left me scratching my head.  Why would house Democrats team up with Governor Sanford against House republicans?  Am I misreading this?
I know that there is more going on than I know about, but this just does not make sense to me.
I have asked Majority Leader Bingham for clarification; I have e-mailed Senator Setzler as well.

Here is the response he says he got from Kenny Bingham:

Thank you for your email and for taking the time to write. As you can probably imagine, as a result of Governor Sanford’s budget vetoes, I have been inundated with emails and phone calls from those who are concerned about the negative impact that these vetoes will have on various agencies of state government. In past years, the General Assembly has been able to override many of the catastrophic vetoes that have been handed down from Governor Sanford. Unfortunately, this year will be different. As those who have closely followed the budget process know, we have had a very difficult time putting together a budget that a majority of members would support.
In the House of Representatives, our first try to pass the final budget conference report, failed by a vote of 47 to 69.  After several days of intense negotiations, we were finally able to pass the budget, but only by the slimmest of margins and without any help from the House Democrats. This set the stage for what we now have before us. As a result of not having the support of House Democrats throughout this years budget process, this allowed the Governor and a group of his closest allies, to hold us hostage with this year’s budget. We were faced with the dilemma of either agreeing to accept his line item vetoes, or he was going to veto the entire budget document which would have required that we start the budget process over from scratch. A process that took 5 months to complete the first time, and one that would have been next to impossible to complete prior to government having to shut down on July 1st.
Therefore, when the House Democrats informed us on the last day of session that they would not help us override the Governor’s veto of the entire budget, we were left with no other real option but to agree to sustain the Governor’s line item vetoes. While this is clearly not the kind of news that I hoped to be sending you, it is unfortunately the truth. So barring the Governor having a change of heart, or some other unforeseen circumstance, I anticipate that the Governor’s vetoes will be sustained.

I must say, I don’t follow it either. No matter what happened with the Democrats during the budget debate (whine, bitch, moan; it’s always somebody else’s fault, preferably someone of the other party, even the completely hapless Democrats), why can’t lawmakers override the vetoes? I mean, that was then; this is now.
Maybe this will make sense to some of y’all; it doesn’t to me.

I disenfranchised myself for ONE positive vote, and it was worth it

On the day of the Republican presidential primary in January 2008, I dropped by the office to check on things, and wandered through the newsroom to see what they knew, if anything.

I was wearing one of those “I Voted” stickers that the Palmetto Project gives out to encourage civic engagement. I’ve always proudly worn one on election days as a visible symbol of being one who cares enough to make the effort, without revealing anything inappropriate (for a newspaper editor) about how I voted.

But John Monk remarked upon it, saying, “I see you voted Republican.” Dang! I had completely forgotten the insane fact that the parties had insisted upon having separate primaries a week apart (yet another reason to hate parties). Flustered, I just said, “Well, of course I did.” If I had thought there was any danger of Barack Obama losing the Democratic primary, I would have had a dilemma on my hands. But while I thought McCain would win the GOP contest, I wasn’t sure of it, and I was damned if I was going to fail to do my bit to prevent my state from committing the travesty it had in 2000, when it gave George W. Bush to the world. It just had never occurred to me not to vote in that primary.

Of course, if you live in the Quail Hollow precinct in Lexington County, you’re accustomed to voting in Republican primaries, if only because that’s the only way you get any choices at all. This morning when I asked for a Democratic ballot, I could not remember ever having done so before since I’ve lived there.

And of course, as a result of taking that ballot, I was disenfranchised in terms of who will be my congressman, my lieutenant governor, my treasurer, my attorney general, my SC House member, and my county councilman. In every one of those, there was no Democratic contest, and in two of them (treasurer and county council) no Democrat at all; in those two this WAS the election (and in several of the others it might as well be).

But it was worth it to cast a positive vote. Yeah, I guess I could have held my nose and hoped that Henry McMaster would govern the way he has served as attorney general, rather than the way he has run as a candidate, and thereby minimized Nikki’s margin of victory. But by taking a Democratic ballot, I actually got to vote for someone I actually want to be my governor, without any reservations. And as I’ve said over and over again, electing the right governor is FAR more important than what happens with any other office. We have got to turn this state around, and as weak as the office of governor is, it’s the one office with a bully enough pulpit to make a difference. No matter how perfect my House member may be, he’s just one vote out of 170, and can’t make news (and thereby influence policy) with a mere word.

And I feel good about it. After all the slime we’ve been dragged through over on the Republican side, from talk about who’s bedding whom to “Vultures” to … well, I just don’t even want to think about it. After all that, to vote positively, without reservation, was a great relief.

This just came in via e-mail:

On June 30th, I will stand before the people of Columbia and swear the oath of office to become mayor.

I am thankful for all of your hard work that has led us to this moment and I remain humbled by the faith you’ve placed in me and my vision for our city.  I know that I would not be here if it weren’t for you.

That’s why I wanted to take a few minutes to give you an update on everything we have done and are doing leading up to July’s transition.

As you may already know, Mayor Coble and City Council have graciously invited me to attend and participate in all City Council meetings and work sessions. While I do not have a vote, I have accepted his invitation and have already attended several meetings and budget work sessions.

I have regular meetings with the city manager and have met with all assistant city managers and department heads in order to gain a full understanding of all the projects and initiatives currently underway as well as ask for their input on how the city can be run more effectively and efficiently.

We have some truly talented and dedicated public servants working for the City of Columbia and I am honored to be working with them.

I am confident that by working together, we can accomplish anything.

While it is vital to learn the ins and outs of City Hall, I remain convinced that the key to creating real and lasting change in Columbia lies beyond those walls in an honest partnership with our regional neighbors.

With that in mind, I have made it a point to meet with or reach out to every mayor in Richland and Lexington Counties as well as the Chairmen for both County Councils in order to begin fostering the regional cooperation and collaboration I campaigned on.

Whether leading the charge on fiscal accountability and transparency, standing up to support first responders, protecting our natural environment, or promoting the arts; our campaign was fundamentally about bringing people together and creating One Columbia.

Now, with the campaign over, I am reaching across the traditional boundaries that have divided us for too long and pulling together a transition team that represents the best South Carolina has to offer.

I will announce the leadership of the transition team this week and start finalizing dates for a series of community meetings across our city.

The One Columbia Listening Tour will give every citizen from every neighborhood a chance to voice your unfiltered ideas and concerns directly to me. But, more importantly, it will give us all an opportunity to find the common ground we share so that together we can start building the future our families deserve.

Graham signals he won’t be pushover on Kagan

Having voted for Justice Sotomayor, and faced with a second Obama Supreme nominee whom other Republicans are saying nice things about, Lindsey Graham seems to be making a point of letting everyone know that he doesn’t ALWAYS go along with the president’s preferences. Today, he announced his opposition to the nomination of Goodwin Liu to the 9th Circuit Court of Appeals in San Francisco thusly:

“I am a big believer in the concept that elections do have consequences.  But I also believe a U.S. Senator has an obligation to ensure nominees to the Court of Appeals understand the difference between an elected official, whose job it is to write laws, and a judge, whose job it is to uphold them.

“I am convinced that Professor Liu does not understand or appreciate this difference.  His writings are very disturbing.  Professor Liu consistently points to various constitutional clauses that he believes empower a judge to be the ‘righter’ of social wrongs.

“My opposition to Professor Liu’s nomination is not a disagreement over judicial philosophy, as I expect this Administration to put forward judges with whom I disagree.  Instead, my opposition to Professor Liu is based on a deep-seated disagreement over the proper role of a judge in our democratic society.

In Professor Liu’s world, the Constitution places virtually no limits on the role of a judge to impose their opinion on almost every area of life.  This leads me to one conclusion – Professor Liu should be in elected politics, not in court as a judge.”

Of course, conservatives won’t be happy with him until he sponsors legislation to disband the 9th Circuit altogether. Personally, I’d probably vote for that myself.

Sen. Graham sets an interesting standard. Of course, it can be argued that the president himself has a disturbing viewpoint of “the proper role of a judge in our democratic society.” In fact, I’ve argued something along those lines myself (in my last column before the election). But that was before the election, and this is now, and besides, the president’s disturbing views on the subject don’t mean he can’t appoint judicial nominees with a proper respect for the constitution. And when he does, as with Sotomayor, I expect Sen. Graham to vote to confirm. That’s his pattern.

Graham not so ‘cool’ now on global warming

Back in late February, Tom Friedman wrote the following about our senior senator:

And for those Republicans who think this is only a loser, Senator Graham says think again: “What is our view of carbon as a party? Are we the party of carbon pollution forever in unlimited amounts? Pricing carbon is the key to energy independence, and the byproduct is that young people look at you differently.” Look at how he is received in colleges today. “Instead of being just one more short, white Republican over 50,” says Graham, “I am now semicool. There is an awareness by young people that I am doing something different.”

But today, we have the following  release from some of his erstwhile young fans:

Youth Activists Demand S.C. Leadership on Energy and Climate Legislation

(Columbia, SC) – Responding to Senator Lindsey Graham’s withdrawal from federal energy legislation and the offshore oil disaster, youth activists in South Carolina have called on the Senator to renew his leadership.

“Students at Clemson were proud to stand behind our hometown Senator in pushing for federal energy and climate legislation,” says Gabriel Fair, co-president of Clemson University’s Student for Environmental Action. “Lindsey Graham’s leadership really encouraged the young people who are fighting to cut carbon pollution and create a clean energy economy in this state.”

Over the previous months, Graham has led in federal energy and climate legislation. In February editorial in the New York Times, Thomas Friedman quoted Graham saying, “I have been to enough college campuses to know if you are 30 or younger this climate issue is not a debate.  It’s a value.  These young people grew up with recycling and a sensitivity to the environment – and the world will be better for it.”

Senator Graham’s withdrawal from the federal energy debate has disappointed students across South Carolina. “We’d like to stand behind our Senator again and hope he comes back to the table and strengthens the bill further,” says Fair.

Students in South Carolina are looking for the jobs comprehensive energy and climate legislation would produce. According to Winthrop University student Lorena Hildebrandt, “Young people face the highest unemployment rates in this country right now. Like many of my friends, I’ll be graduating college soon and looking for a job.  That’s why building a new clean energy economy is so important to young people. It’s absolutely necessary we pass comprehensive federal legislation to create a clean energy economy.”

Graham’s backing away from the process occurs at a crucial time for federal energy legislation.

In light of the unfolding oil disaster in the Gulf of Mexico, Americans are reconsidering our country’s dependence on oil. Recent polls have indicated that the Deepwater Horizon explosion has actually bolstered support for federal climate legislation, while support for drilling is falling.

According to a poll conducted last week by Clean Energy Works, 61 percent of Americans now favor a climate bill that would cut carbon pollution.  Meanwhile, CBS News reported this week that forty-one percent of Americans feel the risks of offshore drilling are too high, up from twenty-eight percent in 2008.

Students on the coast are worried about what Graham’s pulling out will mean for federal legislation on energy and climate. “We’re disappointed here on the coast that Senator Graham walked away from federal energy and climate legislation,” says Marissa Mitzner, Sustainability Coordinator at Coastal Carolina University. “Especially with the oil disaster in the Gulf unfolding and our own South Carolina coasts vulnerable to the impacts of climate change and the threat of oil drilling, we need Senator Graham’s leadership more than ever.”

Face it, senator: You’re not even “semicool” now, not with the kids.

As for what a cool guy like me thinks, well, I’d certainly appreciate a better understanding about why the Dems’ recent moves on immigration mean you can’t lead on this.

Oh, and kids — Tom Friedman didn’t write that in “and editorial.” It was a column. He doesn’t write editorial.

Chief Tandy Carter fired, just like that

Sometimes things actually do move swiftly in Colatown:

Embattled Columbia Police Chief Tandy Carter was fired this morning, following tensions with City Council over the handling of the April 21 car accident involving Columbia Mayor-elect Steve Benjamin.

Carter held a news conference at police headquarters just before noon today, insisting he acted within the scope of the law — and his personal code of ethics.

“I am a professional police chief,” Carter said. “I am not a puppet police chief.”

Well, now he’s not ANY kind of police chief.

I’m still sort of reeling over this. Tandy Carter was a good police chief. And then, in a situation in which it seemed OBVIOUS that the thing to do was bring in another agency, he dug in his heels and got all defensive. And I just don’t understand that.

I was thinking about it over the weekend, and wondering. When someone says, as I have since the start, that he should call in another agency on the Benjamin wreck, does he actually think that we’re saying we don’t trust him? That’s certainly not what I meant to say. I trusted him completely. But, not having been born yesterday, I clearly understood this as a situation in which lots of OTHER people wouldn’t trust him on it (you who read this blog regularly may have noticed that there are a few cynical people out there when it comes to their views of public officials). And there was no way he needed that heat, or Columbia needed the controversy.

This situation got crazy and went bad fast.

I’m still sort of spinning.

Anybody agree with Barrett about the Navy brig?

Now to the substance of what Mullins McLeod was getting on Gresham Barrett about.

As I mentioned before in one of my last columns for the paper, Rep. Barrett didn’t seem to have a reason for running for governor. He could clearly state what he wanted to do, or anything special that he brought to the job (which is probably why he dodged talking to me for a couple of weeks, until I got really insufferable with one of his staffers — avoiding free media is just bizarre behavior in a gubernatorial candidate, and it really stood out), which was not good.

Now, he’s apparently decided he wants to grab attention and break out of the pack in the worst way — which is exactly what he’s done.

In the playbook of the kind of politician who has a very low opinion of the electorate, he’s doing everything right: He’s appealing to xenophobia, to the Not In My Backyard mentality, to insecurity, and sticking it to the administration that happens to be of the other party. He accomplishes all that by griping loudly and obnoxiously about the idea of the Obama administration bringing “detainees” from Guantanamo to the Navy Brig in Charleston.

Folks, I’d just as soon they stay in Gitmo, because I’ve always thought that was an excellent place to keep them, practically speaking. First, it’s off our soil, which keeps them in limbo as far as our legal system is concerned. You’ll say, “But that’s just what’s WRONG with Gitmo,” but the fact is that prisoners who are taken in such unconventional warfare, many of whom are sworn to do anything to harm Americans if given the chance, are different either from people arrested in this country under civil laws or captured in a conventional conflict.

And it’s secure as all get-out.

But… and this is a big “but”… as convenient as it might be for us to keep people whom we believe to be terrorists on a sort of Devil’s Island, as practical as it might be — it hasn’t been good for our country. Why? Because we’re not the 19th century French. We aren’t governed by a Napoleonic Code. We’re all about innocence until proven guilty. And while we may sound like damnable fools for extending such niceties to people who thought 9/11 was really cool and would like to see another, we do stand for certain things, and Gitmo has given this country a huge black eye that it can’t afford. We have to be better than that.

For that reason, even if John McCain had been elected instead of Obama, we’d be closing Guantanamo. (As Lindsey Graham says, we might have done it in a more organized manner, but we’d still be doing it.) And finding a secure place to put those people is part of that process. Guess what? Our allies don’t want them. So we’re stuck with them.

And that makes the brig down in Charleston as good a place as any. Hey, I don’t want them there, but sometimes, somebody besides our men and women in uniform has to put up with something they don’t like in our nation’s greater interest in this War on Terror.

And does anyone truly doubt the ability of the United States Navy to keep those people secure there? I don’t. I suspect we could always transfer up a few more Marines from Guantanamo if we think we don’t have enough security there. It certainly fits the brig’s mission, which is officially stated as follows:

The mission of the Naval Consolidated Brig Charleston is to ensure the security, good order, discipline, and safety of prisoners and detained personnel; to retrain and restore the maximum number of personnel to honorable service; to prepare prisoners for return to civilian life as productive citizens; to prepare long term prisoners for transfer to the Federal Bureau of Prisons or the United States Army Disciplinary Barracks; and when directed by superior authority, detain enemy combatants under laws of war.

So basically, Rep. Barrett’s attempt to score points on this issue is ugly, petty, and insulting.

Just for the sake of argument, does anyone agree with him?

Mullins grabs some attention, but fails on civility

You may recall that I haven’t been too impressed with Mullins McLeod. I’ve generally dismissed his campaign as being… what’s the word… trite, I suppose. His campaign releases have sort of struck a generic populist pose, trying to project him as a regular guy who’s tired, just as you good people out there are, of all them blamed politicians and their shenanigans.

That pose is tiresome enough when done well, but as I said, his populist pronouncements have been so vanilla, as that genre goes, so as to be easily forgettable five minutes later. As I said back here, Mullins just hasn’t been able to get a hit in his few at-bats.

Well, he made a concerted effort to get on base yesterday, when he told Gresham Barrett to “shove it” on the Gitmo prisoners issue. Well, Gresham certainly deserved to have someone call him on his really ugly NIMBY ploy for attention, but while it might be cool for, say, a Dick Harpootlian to say something like that (except that Dick would be more imaginative, and he’d say it in Dwight’s behalf, not Mullins’), that’s not the kind of language we need from one who would be governor.

So basically, Mullins has managed briefly to get our attention by passing first and running the basepaths, but he’s immediately alienated us by coming into seconds with sharpened spikes high, a la Ty Cobb. In other words, the first time he gets our attention, he fails the civility test.

Hey, if we wanted a guy who talks like this as governor, we could turn to Joe Wilson.
